Very little in way of regulation, authority, and litigation should be occurring at the Federal Level. Congress has over delegated its rule making role to agencies which have then imposed authority over state counterparts.
That is not the way it is supposed work. States need to litigate, nullify, legislate to resist over expansion of Federal rule/policy/authority. Otherwise the concept of Federalism or a Constitutional Republic will be lost.
THIS IS TRUE REGARDLESS OF THE PARTY OCCUPYING THE HOUSE, SENATE, OR PRESIDENCY!
They should but won't if their hearts melt in fear.
It is not always about the Constitution of the country. It's also about the constitution of her leaders.
After the Election, Republicans were asking, "Do I have to lead? Can't I just follow?"
"Can I have permission to exert my authority? I'm nervous on a good day. Scared on a bad day."
The Federal Government controls the states through funding. There is only so much government can tax before seeing declining returns (Laffer Curve). The Feds soak up all the taxes (funding) leaving little for the states.
Federal funds come with MASSIVE regulations and strings. We are at the point where accepting federal funds will be more expensive for sates than declining them.
In addition, at some point in the near future the hopelessly financially bankrupt federal government will collapse. When that happens the states will be able to fill the void.
They just need to quit fucking around and secede. Each state would be better off on their own. Even the commie states, after they don't get bailed out they'd kick their governments the fuck out.
10TH AMENDMENT!
The 10th Amendment, baby!! Power to the People AND the States!!
While we're at it, repeal Amendment 17th's mandate to vote in Senators by popular vote ["elected by the people thereof"]; go back to "chosen by States", as it should be. The country has gone rapidly downhilll since the States abdicated this important check-and-balance in our government.
Defund the federal government.
We're too big a country for federal gov't to have this much power.
google "Convention of States". Both parties have been abused by D.C. Get everyone involved!
Psshhhh.....I'd love to see the "state of x" try. flexes
Good point.
