Very little in way of regulation, authority, and litigation should be occurring at the Federal Level. Congress has over delegated its rule making role to agencies which have then imposed authority over state counterparts.
That is not the way it is supposed work. States need to litigate, nullify, legislate to resist over expansion of Federal rule/policy/authority. Otherwise the concept of Federalism or a Constitutional Republic will be lost.

The Federal Government controls the states through funding. There is only so much government can tax before seeing declining returns (Laffer Curve). The Feds soak up all the taxes (funding) leaving little for the states.
Federal funds come with MASSIVE regulations and strings. We are at the point where accepting federal funds will be more expensive for sates than declining them.
In addition, at some point in the near future the hopelessly financially bankrupt federal government will collapse. When that happens the states will be able to fill the void.
