Argument two: a citizen is being pursued by two armed men in a motor vehicle. The armed men are not uniformed police officers, so the citizen cannot discern whether they are trying to perform an arrest or trying to kill him. Since he is on foot and his pursuers are in a vehicle, he believes he cannot flee. The citizen is in a valid belief that his life is in danger and cannot flee, and therefore resorts to grabbing the weapons of the pursuer in order to defend himself.
Here's the thing though: I believe both arguments are compelling. And I don't know how to resolve this. Given both arguments, we have arrived at the conclusion that both men are acting in self-defense. Which shouldn't be possible. But I don't see a way out of this.
If you are able to pick my argument apart, I would welcome it. This contradiction has been bothering me ever since I heard about what happened. But I cannot think of a way to resolve it. So if there's an error in my argument or if there's something I'm missing, I welcome counterarguments.

The act of pursuit is upstream to the act of shooting. The justification of the shooting is only relevant at the point in time when the shot was fired. Everything prior to the shooting is only valid in terms of what was in the shooter's mind at the time he pulled the trigger. At that exact point in time what was in the shooter's mind? Does what was in his mind make the shooting justifiable? The answer in this case is categorically Yes. For one, there is no evidence that the shooter intended to do anything other than conduct a lawful citizen's arrest. He could easily have shot the jogger from range as he ran along the road. For two, the jogger discarded a myriad of options in favour of aggressively closing with and attempting to seize the firearm, while in the presence of other people who also have firearms. The only conclusion a reasonable person in that circumstance can come to at that point in time is that he wanted the firearm in order to use it.
Note: if you believe that they were unjustified in attempting a citizen's arrest armed with guns; the previous burglary reported to police in the neighbourhood was a handgun stolen from McMichael's truck. So the McMichaels were in the reasonable belief that the burglar was likely to be armed.

No, this isn't pantomime. We all share common languages; verbal and physical. In context, Abery is supposedly a "jogger" in a safe neighbourhood in broad daylight. Note: It's frequently reported that Abery was jogging in Brunswick when he entered Satilla Shores. Satilla Shores is 8.6 miles from Brunswick. So he's not just jogging, he doing a half-marathon!
The McMichaels drive at least 20m past (nonverbal communication!) the running Arbery, stop their vehicle (nonverbal communication) and get out (nonverbal communication). They make the demand to Arbery to stop (verbal communication). Arbery doesn't stop, or reverse direction, he continues on running forward, he diverts, passing their truck on the passenger side, so McMichael loses sight of him, then Abery cuts back around the front of the vehicle and lunges for McMichael's gun.

The fear that he is experiencing is the fear of going to prison. There hasn't been a lynching in the USA since 1981, and this is a safe neighbourhood in broad daylight. Think about the contradiction here; Arbery is relaxed enough to go jogging in this neighbourhood, and a have a wander through some houses under construction, but he's also somehow immediately in fear of his life following the arrival of the McMichaels. Another reason that this is a deeply flawed argument is that the risk to the Arbery's life is far higher in closing with McMichael and wrestling for the gun, as opposed to literally any other action he could take at that point in time. He could continue running, slow down to a walk, call for help, try to reason with them, comply with their directions. Any of those would be reasonable actions to take and all carry far less risk than an attempt on one of the *several *guns present. Think about what was in Arbery's mind at the time he tried for the gun. There is another gun to deal with. If he had succeeded in gaining possession of that gun, he was almost certainly going to be shot by the other McMichael. "I'm jogging here, call the police, I'm not going anywhere, can you please lower the barrel while we wait?" These are all reasonable responses, lunging for the gun is not reasonable unless you're very low IQ and violent and under the belief that you're in a A LOT of trouble. Not what a jogger who's just covered 8 miles would likely be thinking.
Furthermore, McMichael knows this (consciously or not), so the unreasonable act of the jogger closing and getting physical has a clearly extremely dangerous implication to the shooter. "He is not trying to escape, he's not rational, he's violent, and he wants my gun." The logical conclusion here is that he wants to use it.
Lastly, there's a lot more that we aren't told in this case which should set off your bullshit detector. Abery is from Richmond (3 hrs away), and was buried in Waynesboro (2.5hrs away). Not once has the media reported him to be a local resident of Brunswick or Satilla Shore, despite the "jogging" narrative. So, what exactly was he doing there?
If the McMichaels go down for this (unlikely) it'll be a massive miscarriage of justice. I suspect this is why the case is on it's FOURTH prosecutor now.

What exactly is argument two that you find to be a "solid argument".
Argument two: a citizen is being pursued by two armed men in a motor vehicle. The armed men are not uniformed police officers, so the citizen cannot discern whether they are trying to perform an arrest or trying to kill him. Since he is on foot and his pursuers are in a vehicle, he believes he cannot flee. The citizen is in a valid belief that his life is in danger and cannot flee, and therefore resorts to grabbing the weapons of the pursuer in order to defend himself.
Here's the thing though: I believe both arguments are compelling. And I don't know how to resolve this. Given both arguments, we have arrived at the conclusion that both men are acting in self-defense. Which shouldn't be possible. But I don't see a way out of this.

The act of pursuit is upstream to the act of shooting. The justification of the shooting is only relevant at the point in time when the shot was fired. Everything prior to the shooting is only valid in terms of what was in the shooter's mind at the time he pulled the trigger. At that exact point in time what was in the shooter's mind? Does what was in his mind make the shooting justifiable? The answer in this case is categorically Yes. For one, there is no evidence that the shooter intended to do anything other than conduct a lawful citizen's arrest. He could easily have shot the jogger from range as he ran along the road. For two, the jogger discarded a myriad of options in favour of aggressively closing with and attempting to seize the firearm, while in the presence of other people who also have firearms. The only conclusion a reasonable person in that circumstance can come to at that point in time is that he wanted the firearm in order to use it.
Note: if you believe that they were unjustified in attempting a citizen's arrest armed with guns; the previous burglary reported to police in the neighbourhood was a handgun stolen from McMichael's truck. So the McMichaels were in the reasonable belief that the burglar was likely to be armed.
This is not the strongest point, but I want to address the "uniformed police" argument. Plain clothes police/DEA etc stop people at gun-point all the time, and THEN produce identification from their pocket or undershirt. Them saying "police" holds no weight to a criminal, it's the gun that stops them. Your argument here opens the door that it's OK to fight plain clothes agents because the criminal "might be in fear of their life, therefore it's rational to take on the man with the gun and it's murder if they shoot him". This argument reduces criminals to the level of the dumb unthinking brute animals that lash out when their space is invaded. This is how Leftists actually view blacks, so be careful there.

The McMichaels drive at least 20m past (nonverbal communication!) the running Arbery, stop their vehicle (nonverbal communication) and get out (nonverbal communication). They make the demand to Arbery to stop (verbal communication). Arbery doesn't stop, or reverse direction, he continues on running forward, he diverts, passing their truck on the passenger side, so McMichael loses sight of him, then Abery cuts back around the front of the vehicle and lunges for McMichael's gun.

The fear that he is experiencing is the fear of going to prison. There hasn't been a lynching in the USA since 1981, and this is a safe neighbourhood in broad daylight. White males are not going around executing blacks and certainly not for property crime. If Arbery truly was jogging in the area (he wasn't), then he has even less justification for being afraid. Think about the contradiction here; Arbery is relaxed enough to go jogging in this neighbourhood, and a have a wander through some houses under construction, but he's also somehow immediately in fear of his life following the arrival of the McMichaels. That doesn't follow.
Another reason that this is a deeply flawed argument is that the risk to the Arbery's life is far higher in closing with McMichael and wrestling for the gun, as opposed to literally any other action he could take at that point in time. He could continue running, slow down to a walk, call for help, try to reason with them, comply with their directions. Any of those would be reasonable actions to take and all carry far less risk than an attempt on one of the *several *guns present. Think about what was in Arbery's mind at the time he tried for the gun. There is another gun to deal with. If he had succeeded in gaining possession of that gun, he was almost certainly going to be shot by the other McMichael. "I'm jogging here, call the police, I'm not going anywhere, can you please lower the barrel while we wait?" These are all reasonable responses, lunging for the gun is not reasonable unless you're very low IQ and violent and under the belief that you're in a A LOT of trouble. Not what a jogger who's just covered 8 miles would likely be thinking.
Furthermore, McMichael knows this (consciously or not), so the unreasonable act of the jogger closing and getting physical has a clearly extremely dangerous implication to the shooter. "He is not trying to escape, he's not rational, he's violent, and he wants my gun." The logical conclusion here is that he wants to use it.
Lastly, there's a lot more that we aren't told in this case which should set off your bullshit detector. Abery is from Richmond (3 hrs away), and was buried in Waynesboro (2.5hrs away). Not once has the media reported him to be a local resident of Brunswick or Satilla Shore, despite the "jogging" narrative. So, what exactly was he doing there?
If the McMichaels go down for this (unlikely) it'll be a massive miscarriage of justice. I suspect this is why the case is on it's FOURTH prosecutor now.
