All they can do is give opinions on the court and agree or dissent. They are also outspoken on conservative constitutional approach to the law. Not sure what you'd be expecting.
They can actually take a stand in court, but they won't do that.
Even the last time Thomas gave a statement, it was lukewarm in emphasizing his role. He basically just said "I don't think this is right but I will excuse myself from the ruling".
