OP says 8th graders. I was 12 when I entered 8th grade, most were 13. At 8 I entered 4th grade. A significant difference. Still ...

Yeah, neither is good and both are illegal. I'm more about keeping facts straight than claiming anything is somehow "good" about this.

Others have laid out how this could be prosecuted. I hope that will happen.
