I actually just thought about this and it may very well lose a constitutional challenge because of the precedent set by Roe v Wade and the way that opinion was written (specifically about doctor privacy). Get ready for another shit show in the courts boys.
Except now we actually have a right wing court. And before you say "but but but election fraud", the justices are super conservative on these social issues.
They are but, the conservative judges, with the arguable exceptions of Clarence and Alito, usually go along with precedent that they don't necessarily agree with quite heavily. ACB would be a toss up, because there currently isn't a reliance on transgendering children. But I could really see it going either way BECAUSE of how Row v Wade was written.
