Two reasons:
Sovereign Immunity You can't sue government officials for their policies or decisions unless you can prove they acted with malice. Being stupid isn't a crime.
Cuomo gave nursing homes Immunity when Cuomo directed nursing homes to take in COVID positive people, the nursing home owners pushed back. So to satisfy their concerns (they're political contributors to his campaign), he gave them Immunity from lawsuits for any action related to his order.
So for a lawsuit to succeed, you'd have to proove that they knew the result of their actions, and that it was clearly worse than another course of action they were aware of.
To me giving immunity to the nursing homes means he knew what happened. Giving immunity when you know they are gonna screw up is acting with malice.

It shows that the nursing home owners knew that it would spread the infection, which means Cuomo knew. However, Cuomo can use as his defense that he had to free hospital space for what "experts" predicted would be a huge number of sick people. He viewed it as balancing one risk with another. Without hindsight of one risk being realized and the other not, you can't say it was malice. You have to show that a clearly better approach was available and known to him, yet he still took his action.
One potential hole in this defense is that he continued the policy past the height of the hospitalization surge. However, the fact that he was surprised in an early summer press conference that most victims were staying at home seems to indicate that he's just grossly incompetent. And being stupid isn't a crime by itself.
What about covering up the numbers?
He certainly did that, but does it constitute a crime? Maybe.
I'm not familiar with NY law, so I don't know if withholding or lying about data is a crime. The data wasn't under supeona when he lied as far as I know, so it's not contempt. He can be impeached and removed from office over it, as he failed to dutifully execute the powers of the office. That at least ends his public career.
This is a stretch, but it's possible that by lying about what happened, he influenced policy elsewhere, which caused more people to die. It's akin to a company lying about the known dangers of its product.
