Because they can't get a 1st or 2nd degree to stick .... because of the facts. This is to give the jury another charge to save face with. If he's accused of 3 different murder levels and we can't do 1 or 2 he must AT LEAST be guilty of 3. Get it? This should be considered jury tampering BY THE JUDGE.
