There is no judgement call to be made. If you don't have the data to support what you're doing there's no reason the people shouldn't be as free as possible.
It's ridiculous to suggest that you should be able to limit freedom without any evidence behind what you're doing. Hell, even in almost all cases people should be free even if you do have evidence.
