What about the combination of double jeopardy and lesser included charges?
If you go for a higher criminal charge and fail, you've failed at all the lesser included charges as well.
Example.
Murder: you can't charge someone with murder and attempted murder. If you're charging them with murder, attempted murder is included in the murder charge. Once acquitted, you are acquitted of all lesser included charges.
Basically if you're acquitted of murder they can't come back and charge you with attempted murder.
