Not with 3rd degree. 3rd degree is basically you harmed someone on purpose and they died but you did not mean for them to die. They are still going to have to prove that the knee on the back is what killed floyd (which will be hard to do) and that Chauvin was intentionally trying to harm floyd (which actually may be feasible because he left his knee on his back for over 8 freaking minutes)
Considering he was acting in the capacity of his job and the Minneapolis PD has that maneuver as standard training they probably can't unless its a kangaroo court.
Use that approved hold while the perp is struggling? This is ENTIRELY different from continuing to apply that same hold 5 minutes later. Which is again different from continuing to apply it after he's clearly unconscious, and possibly dead.
One big fact this could hinge on is when did CPR start? I haven't seen a straight answer. If it was immediately upon getting in the ambulance, then GF died under Chauvin's knee and 3rd degree murder isn't such a stretch. If GF was alert and joking in the ambulance and CPR wasn't started until well after they got to the hospital, I don't see how they convict of anything.
Also, is there an expert who can testify GF wouldve died from that dose even with no Police contact?
