That's quite a salacious way to frame it. What the article says is that she was arrested on assault charges and health code violation (among others) after turning herself in to the police.
The charges can still change by the time it goes to trial, but for it to be a hate crime, the DA would have to prove that she did it because the driver was Asian, not because he told her to wear a mask and she wouldn't comply. I didn't see anything in the video that would imply the former.
If you didn't want Chauvin to be charged for murder, you shouldn't want her to be charged with a hate crime. What she did was awful and evil, and she certainly deserves to be punished, but let's give her some credit for showing remorse and doing the right thing and turning herself in.
