My neighbour who, one would think, is intelligent (he's a paleontologist who isn't unemployed) stole from me. I literally had to yell at a man twice my age and explain to him that if you come onto my property and take something without me knowing, it's theft. (a furnace)
He tried to argue that he thought I was throwing it out. He actually argued that "He thought I thought it was worthless garbage.. and so..." Basically because he thought it still had value and he surmised that I didn't want it.. he would liberate it and give it a new home.
After explaining the basics of the law and what constitutes trespassing and theft.. and explaining the general rule of thumb that you ASK for something in exchange for something else (typically) at least giving me the opportunity to say "No, it's ok you can have it for free"... without giving me that opportunity it's theft... he still wouldn't agree he 'stole' anything and offered to bring it back.
I don't know how we're going to get through this if actual 'intellectuals' can't understand that if you rob a bank and bring the money back later and say sorry its still a crime committed. Even if you break into my house and take milk from the fridge because you thought I wasn't going to drink it.

I would definitely press charges. Maybe he'll become a little more educated about how things work. I'm sure he'll use his same logic with the police. We'll see how that works out for him.

Was it on the curb? Dont kno bout the rest of the country but here in Florida,, thats the way. Garbage on the curb is considered public & It is common for people go around scrapping for metal or picking up a table someone has set out.
No it was beside the house, behind my dump trailer, on top of my scrap metal pile... (I bought the property and have slowly been throwing anything metal into a big pile.. Furnace from inside the house included).. (we're talking ~80-100metres from the road)
Only reason he knew it was there was because he came over to chat while I was hauling it out of the house... said at the time it could be re-used to heat someone's garage... I didn't deny that as a fact but certainly never said he could take it.
We were getting a ton of snow one night and he made an executive decision to go 'save it' from snow damage... but forgot to make the executive decision to text me he was doing it.
