I think it's beyond them to even wait 22 months required if they haven't destroyed them yet. The way things go, they'd get a slap on the wrist at best, maybe an investigation that lasts long enough for the 22 months to expire, and say "it's moot now anyway".
There really needs to be anti "Coincidence" laws for this sort of thing just to make sure "tragic accidents" dont "Accidentally" wipe away the evidence that would be collected in court.
Expect all of the states that were accused of this to drag this out for 22 months after which they can destroy the ballots.
