I think it's actually an honest observation that the payout implies wrongdoing and may prejudice the jury toward guilt before any evidence is considered. This may actually get the trial moved.

Just because it's related for those who've never heard of it there's a podcast called "Watching the Watchers" its a conservative leaning defense lawyer whose been covering the floyd trial. He does a good job of providing facts and analysis and separating which portions are hey this is the law and how it applies and which portions are his opinions. Definitely worth a watch
