Anyone know what my best options are or what I should do next besides look for another job obviously? I have it in my termination letter the exact reason stating me not getting a test. Virginia is my state.

I am dealing with this exact thing, fortunately I am in a position where they cannot fire me, but they can stop me from coming to work, at which point I would have to work from home. I do not want to do this as I enjoy going to lab.

They "can" force this, but the terminology you want to use is "sincerely held religious or non-theistic beliefs held with the conviction of traditional religious beliefs as defined by Title VII of the Civil Rights Act and Department of Labor."

I am arguing that, I do not appose the test and if I received a positive test I would do everything in my power to inform everyone I put at risk. However, I have a moral objection to handing the power over ones medical data and autonomy to an entity which has power over my livelihood. I think they have removed me from the random employee testing pool.

Spez: What they are required to do is at least try to find a "reasonable accommodation." For which you could offer to "monitor your health and take measures if you are sick to inform people for which you might have put at risk."

yeah, it will depending on what state you are in, but you will be able to get by. And, if you are so motivated, getting on unemployment will also automatically qualify you for SNAP. unemployment checks and food stamps for at least a year.

It's the funniest shit. I'm not wearing a mask. Or getting tested. They keep telling me I have to wear a mask I say I'm not. And at the same time they are conflicted because I have a decent work ethic probably the best there.

It took my boss showing up to my house unannounced during my quarantine and me opening the door like WTF for him to fire me the next day during my quarantine lmao. It wasn't a company wide request and I declined because my insurance doesnt cover it, I was the reason for the test, I had a rapid test come back negative and no symptoms after about a week from that test. That wasn't good enough for him so until I got tested I was unable to return to work in one email and then he fired me in another.

You should definetly see an attorney ....I don't think any state allows this kind of singling out, but check with your state. Was there ever an offer by the company to cover the cost? Even if you are in an "at will" state, there are limits to what a company can ask of you. I would reject it also, but one of my reasons is ownership of my DNA. This means you cannot sue for this reason. Sorry.

Basically in at will states you have to proove civil rights violation (age, gender, race, religion).

Youd have to tie the refusal to test to religious cause? Probably a huge stretch to just make up that beleif after the fact.

It’s a health privacy issue. The employer cannot ask an employee to get a pregnancy test, STD test, test for diabetes, or any other damned test and could be sued for asking . This should be no different and isn’t. It’s the same thing.

Not if he fired me during my quarantine. He and I agreed to 2 weeks quarantine and for me to take a PCR test to come back to work following VDH guidelines. He fired me before my two weeks finished, I was following VDH guidelines. Since it was illegal for him to have me do a forced medical procedure and fired me over it, he broke he law.

As an At-Will state, Virginia employers can fire anyone for anything that is legal. Some man or woman has to prove that the reason he or she was fired illegally before a judge would award damages.

Is it legal to order someone to get a vaccine as a condition to maintain employed? If you asked on day 7 of the lockdown a frightened judge might say yes. Perhaps now it would be different.

You could also go on a campaign to expose and damage the company and key employees.

I don't think you going to have much ground to stand on. If you were fired for refusing a vaccine, you would definitely have a case, but refusing a test? No so sure.

Best advice I could give is contact a solicitor specializing in wrongful termination. I get the feeling refusing a covid test will be the same as refusing a drug test.
