Anyone know what my best options are or what I should do next besides look for another job obviously? I have it in my termination letter the exact reason stating me not getting a test. Virginia is my state.

Sounds like lawsuit time
On what grounds is the main thing. I have him for shorting my hours and consulted a lawyer but its too minimal for him to take the case as I can get the Federal Gov to handle my hours he said.
Don’t worry about if you have a case. Get a lawyer. They’ll send a letter on your behalf and they probably settle.
This pede lawyers.
They'll settle.
Wrongful termination. Look for a job. Have old employer pay for lost wages (time between jobs, lower wages in new job if applicable) and attorney fees. We need these suits to stop this shit, so don't let us down.
Right to work state. They can fire you for any reason
Sure, but not for an illegal reason.
Thats not how that works
Just get free consultations. I had to go through five firms to get one that was willing to take a case on unpaid wages because they cucked out at the mention of the other things.
Thanks, I will try this.
maybe force a test when you are not sick? uh forcing you do do something something?
Or your state. Look for something like a wage and labor board.

Consult an attorney as to forced medical procedures
This is the right terminology. A covid test is a medical procedure. Your employer is not entitled this information and your right to privacy in these matters are legally protected.
Thanks, if he fights my unemployment he’s got this coming.
You have a right to medical privacy...
Do it anyways.
I am dealing with this exact thing, fortunately I am in a position where they cannot fire me, but they can stop me from coming to work, at which point I would have to work from home. I do not want to do this as I enjoy going to lab.
They "can" force this, but the terminology you want to use is "sincerely held religious or non-theistic beliefs held with the conviction of traditional religious beliefs as defined by Title VII of the Civil Rights Act and Department of Labor."
I am arguing that, I do not appose the test and if I received a positive test I would do everything in my power to inform everyone I put at risk. However, I have a moral objection to handing the power over ones medical data and autonomy to an entity which has power over my livelihood. I think they have removed me from the random employee testing pool.
Spez: What they are required to do is at least try to find a "reasonable accommodation." For which you could offer to "monitor your health and take measures if you are sick to inform people for which you might have put at risk."
get on unemployment!!
This is my first goal. I'm sad I missed the bonus but oh well.
yeah, well, the democrats extended it until September. Been telling everyone because of this joke of a person they are calling the President now- take full advantage of everything you can. f them
Oh shit lol. Well then I'm about to make more money now than ever. RIP to ethics.
I say milk them for all they're worth. buy an AR-15 a week.
This and dumping it all in crypto. I have enough saved that I could kick back for a year anyways. This is all play money now.
Silver, lead, and steel here.
And lots and lots of brass.
good luck Pede. You will get close to 1k a week, for sure.
Thanks, I guess so far getting fired for being American is working out. Oof.
yeah, it will depending on what state you are in, but you will be able to get by. And, if you are so motivated, getting on unemployment will also automatically qualify you for SNAP. unemployment checks and food stamps for at least a year.
What do you recommend I put down for reason I was fired. "I didn't get multiple COVID test in the time frame given after testing negative"
I'm getting 1000 a week in Illinois right now
It’s already your money. They take your money and then make you feel guilty lika a beggar for taking it back.
No shit. I am
Lucky, I've been trying to get fired from my job and I live in California.
It's the funniest shit. I'm not wearing a mask. Or getting tested. They keep telling me I have to wear a mask I say I'm not. And at the same time they are conflicted because I have a decent work ethic probably the best there.
Lol I wish you luck, I refused to wear a mask too. I literally carried half of the team at work and created and built a successful department. Even my termination letter acknowledges it, thanks for being forced to give credit where credit is due and thanks for wrongfully terminating me. It took my boss showing up to my house unannounced during my quarantine and me opening the door like WTF for him to fire me the next day during my quarantine lmao. He fucked himself and set me up good. Thanks Biden lmao. He can, but really can’t, reject my unemployment because of his timing hahaha. Dumbass duck.
Wow, lawyer up!
CA is an 'at will' state...they can fire you for any reason they want.
Not ANY reason, and medical privacy is real. Right to work does have some safe guards but very few.
Just get a new job first and then sue. Doesn't sound like it was a great gig so let the baby have his bottle.
Firing you for not getting a medical exam that wasn't covered is probably grounds for some grievance at least with your state's labor commission but yeah you're probably not going to get your money and time's worth if you really lean into this.

Was this a company wide request? Why did you decline?
It wasn't a company wide request and I declined because my insurance doesnt cover it, I was the reason for the test, I had a rapid test come back negative and no symptoms after about a week from that test. That wasn't good enough for him so until I got tested I was unable to return to work in one email and then he fired me in another.
Sounds like you worked for a retard.
He is a retard. I'm glad I no longer work for him but I am sad I don't get my discount.
So you had a (rapid) test come back negative? And your company denied that? Demand the company put in writing why such tests are not good enough. Explain to them that the science is settled. And how they are evil Drumpf supporters if they don't believe the religion of testing. Amazing how your tale will probably hit all of us eventually when someone unilaterally decides bad policy.
You should definetly see an attorney ....I don't think any state allows this kind of singling out, but check with your state. Was there ever an offer by the company to cover the cost? Even if you are in an "at will" state, there are limits to what a company can ask of you. I would reject it also, but one of my reasons is ownership of my DNA. But if you need a win right now, read Psalms 37kjv , and I hope you will find comfort that nothing is hidden..(that's Psalms, not Palms!)...🐸🇺🇸
Sign up for every assistance program you qualify for & bleed this motherfucker dry. I am serious. Now is not the time to be too proud to use it. Pride comes before the fall.
What all programs are there? I know unemployment but what else should I sign up for? I'm ok with bleeding him dry.
EBT
The ebt, Medicaid, all of that shit. If you qualify, that is what it is there for. At least you would use it the right way, not the left way.
If you don’t have an attorney within the next week, File a claim with the EEOC! (You only have 30 days after termination).
You’ll have to be specific in the filing, but they have to prove why the COVID test was required and that they did not discriminate based on such COVID.
find a good conservative lawyer
I'm still waiting for Giuliani, Lynnwood, and Sidney Powell to deliver
Get a lawyer! The vaccine is experimental and they can't force you to get it!
First apply for unemployment tomorrow! Your place of work can deny it but you then can fight them and win especially if they have never required you to get flu shots hep B shots etc in the past! Then get a lawyer n sue!
How can he deny it. On what precedent? He can’t be like yea I forced him to get a medical procedure and fired him since he didn’t because then he’s admitting guilt haha. He is pretty much fucked?
Virginia is an at-will employment state.
This means you cannot sue for this reason. Sorry.
Basically in at will states you have to proove civil rights violation (age, gender, race, religion).
Youd have to tie the refusal to test to religious cause? Probably a huge stretch to just make up that beleif after the fact.
Not a laywer, not legal advice.
It’s a health privacy issue. The employer cannot ask an employee to get a pregnancy test, STD test, test for diabetes, or any other damned test and could be sued for asking . This should be no different and isn’t. It’s the same thing.
There is a possibility that this falls under a religious civil rights issue.
Lawsuit.
Not if he fired me during my quarantine. He and I agreed to 2 weeks quarantine and for me to take a PCR test to come back to work following VDH guidelines. He fired me before my two weeks finished, I was following VDH guidelines. Since it was illegal for him to have me do a forced medical procedure and fired me over it, he broke he law.
It is NOT illegal I hate to tell ya man...
Test Question from a lawyers website.
It is legal to require your employees (or employees in certain job categories) to get a physical examination once a year.
A. TRUE, because an annual physical is important for wellness.
B. TRUE, because you have the right to ensure that your employees are in good health.
C. FALSE, because this would be an invasion of privacy.
D. FALSE, because once an employee has started work, you can require medical examinations only if they are job-related and consistent with business necessity or performed in connection with a voluntary wellness program.
ANSWER: D. You can't require a current employee to have any type of medical examination unless the examination is job-related or consistent with business necessity.
A negative Covid test falls under a 'business necessity'
Yea but he agreed to keep paying me for my time off so he is still liable under FFRCA to follow all mandates meaning he can’t fire me like he did.
As an At-Will state, Virginia employers can fire anyone for anything that is legal. Some man or woman has to prove that the reason he or she was fired illegally before a judge would award damages.
Is it legal to order someone to get a vaccine as a condition to maintain employed? If you asked on day 7 of the lockdown a frightened judge might say yes. Perhaps now it would be different.
You could also go on a campaign to expose and damage the company and key employees.
My proof of vaccine id is next to my voter id....
I don't think you going to have much ground to stand on. If you were fired for refusing a vaccine, you would definitely have a case, but refusing a test? No so sure.
Best advice I could give is contact a solicitor specializing in wrongful termination. I get the feeling refusing a covid test will be the same as refusing a drug test.
Covid testing is a medical procedure. You can not be forced to have a medical procedure.
What about drug tests. That's as much a medical procedure as a covid test and your compelled by law to participate in drug test for work.
That’s exempted by the Federal Drug Free Workplace act.
Pissing in a cup isn't a medical procedure. A probation officer can also have you piss in a cup and they are far from a medical professional.
Makes sense. Glad you clear that up for me
Get a copy of your employee handbook and any other relevant documents ASAP. This requirement must be spelled out and acknowledged before hand.
Knowing what you're job is would be helpful though. If Healthcare its complicated otherwise you cannot be forced to be a Guinea pig.
Get a. Attorney ASAP & Put notice out asking for anyone else in the same situation.
Slaughter all scum and you will feel better and have done a service to your country
According to federal law, none of us can be mandated to take a vaccine that has NOT had proper clinical trials. NONE of these vaccines ever had them.
Virginia is a commonwealth and right to work use your stimmy to get a consultation with a lawyer see if its worth pursuing. Some lawyers will take this kind of work with pay if you win stipulations. Good luck fren!
I rather not say but it was a local mom and pop shop with less than 5 employees.
I’ve been researching this, since I think I’ll be up on the chopping block soon too.
At less than five employees, I’m not sure you’re going to have much luck honestly.. small businesses are treated much much looser than ones with more employees.
Probably scared as hell to have everyone out sick and to lose their family business. Bonus terror points if they were in the food industry.
If it's just a test why didn't you take it. Unless it's an anal swab, looks pretty harmless to me. They're not forcing you to put a mask on after all.
Just get on the train, it's for your safety
Why didnt you just fuck the tranny? Unless heshe had aids or something, anal sex with a trans seems pretty harmless to me. They're not forcing you to put a mask on after all.
I told my employer early last year that I would quit before taking covid test. If reopening depended on lower positive tests, then I will do my part by not being tested.
Don't quit. Make them fire you. If they're willing to write "refused COVID test" on your termination letter, guess what: YOU WIN.
Lmao that’s pretty much exactly what this dude wrote. LMAO. Teach me how to win from this.
