I'd be sure to sue him for actual expenses plus pain and suffering which could be several times more than the resale value of the house.
They also used a hard money loan, which is odd, since they usually won't lend to you if you intend to be an owner occupant. Hard money is only for flips and rentals.
The seller is a piece of shit but sorry to say this is why you have closing costs. If they didn't have a lawyer to do the closing then they learned this is why you should. If they did, they should sue the lawyer because this is definitely something that is the lawyer and real estate agents' responsibility to prevent. I think it has been going on a lot lately where someone will put their house up without having arrangements to move out, and then an idiot will get into a bidding war and skip all of the contingencies which I guess now could technically include making sure the person is going to leave

The seller should've been at the closing, the buyer should've been moving in rite after the closing. If the seller tried to pull something rite then the buyer should've just thrown them out and moved their stuff in, because the the seller should've been moved out prior to the walk through, with the fresh closing papers in hand any cop would've told the seller to pound sand.

This is why you do a walk through immediately before closing, to inspect that the house is in the same condition and ready for you to move in.
