I understand that if a restaurant wants to ask for a vaccination card and I decline to disclose that info they could just point to the sign above the door that says they reserve the right to refuse service and tell me to leave.

That aside, could I always decline to disclose that type of information to any business or government agency or police officer or anyone else since what they're asking me for would be protected as a medical record under HIPAA? It seems like if I'm administered medical treatment it would be sensitive information I would need to release in writing but then again the shots aren't being administered by a doctor or under their orders so does it even qualify? Do they consider it no more protected than whether or not you took an aspirin with your morning coffee?

So HIPPA only prohibits medical providers (hospitals, physicians, pharmacies, etc) from disclosing your medical information to third parties except for specific reasons (your doctor sending records to a surgeon for an upcoming surgery for instance) or unless you authorize the disclosure.

HIPPA wouldn’t restrict a restaurant from requiring you to confirm you were vaccinated. If you didn’t want to share, then the restaurant has the right to refuse you entry (unless some local law would apply).

Now, I think the bigger question you should be asking is the legality behind hospitals sending your information into the CDC database once you get vaccinated.
