She's claiming that her Dominion claims are now "opinion" and not "fact".

Combined with her lead witness caught lying about his credentials, I often suspected she was purposely mislead to distract from the real mail-in ballot fraud.

Why is she asking them to dismiss at all? Shouldn't she be daring them to take her to court, so in discovery, she can access all machines and evidence?

Its truly a shame, because the election was obviously stolen. Just not the way that Powell claims. Its a lot more exciting to say "there's a vast international communist plot from a dead dictator in Venezuela to switch votes, and they were switching votes from a secret control room overseas! And the servers were seized and we think the good guys have the servers!" and then further claim that Trump won 410 electoral votes and then go even further and claim that Trump won every single state in 2016 like she did on Twitter.

People latched onto that stuff because its a lot more exciting than boring old mail-in ballot fraud, and makes the claim that Trump won a lot bigger than we thought (HE WON EVERY STATE! HE ALSO WON EVERY STATE IN 2016 BECAUSE THEY WERE FLIPPING VOTES AT A 1:3 MARGIN!)

And because of this, a ton of people completely forget about the mail-in fraud. They are only focused on Dominion. It almost makes me think she was mislead intentionally to dangle the shiny Dominion in front of people to distract from the very real mail-in ballot fraud.

There are truly no words to accurately express just how damn irritated I am with all the lies. What ever happened to being honest and a good person?

I cry for my fellow American's. My heart breaks as I drive through run down neighborhoods and I think about how residences are falling apart but at least they are able to pay those damn taxes.

My heart breaks when I see families being told that they can't operate their business that they worked so hard to build.

My heart breaks when I think about all of the children who are going to have to deal with this shit in the future. The lies and heartbreak of a life that is never theirs fully.

I'm a mom who had somewhat of hope in a system I haven't been familiarized with until the past few years. Being only 30, I hadn't experienced all of the letdowns that the generations before me did. My father in law was right the whole time when things were coming out and he said "Nothing good would happen" and I tried to hold onto faith that maybe someone in power would care but at this rate, Marjorie will be coming out a week saying that she was really just trolling us for roundup lists. Like wtf!

Greed. I suspect that Powell and Wood started seeing how many donations they were getting by taking the spotlight and then repeating more and more substantial and exciting claims. It was amazing how much attention they got and how many followers they were acquiring. They stole the attention from the boring (but very real) mail in ballot fraud to make claims of secret control rooms and CIA servers being seized, and gun battles between the military and CIA. All of this kept the donations rolling in. I was shocked when I saw how sloppy Powell's lawsuit was as if she just took everything submitted to her without vetting the info and witnesses and tossed it all together.

That article just confirmed she said her theories are her own opinions and "not facts that the public would immediately believe."

I often was suspicious of some her claims and how they distracted from the mail-in ballot fraud. Its a lot more exciting to claim there's secret control rooms, satellites, foreign powers, plots from Hugo Chavez, and hacking rather than just lain old mail-in ballot fraud. Especially when those exciting claims were sending in all the big donations to her.

It's a defamation suit. Her stance is that the public would not immediately believe the claims but would instead want a court to render judgment. This is a good defense. She also points out jurisdictional flaws and requests it be moved to Texas.

Which strategy would you employ in a defamation suit brought in a venue bent on your destruction?

Sure, she "believes her allegations" except now she's framing them as "she believes in her opinions."

If you read the official filing, it essentially says her claims are "based on witnesses, and that she believes them, but they need to be tested and vetted in court before people should consider them fact."

Its a way to cover her ass and try to force the court to dismiss the case. Despite her previously saying she HOPES Dominion sues her so that she can present all the "evidence and receipts" she has or saying that "discovery is going to be fun" when initially Dominion sued her. Why the sudden change to get them to dismiss it now?

Ultimately, her language now is a far cry of how she was framing and talking in speeches and interviews with "she has all the evidence and receipts and can prove Dominion flipped and altered votes."

My point is, if she really believed in her claims, she would want to continue the defamation suit.

Now is her chance to be able to present the evidence she has.

Dominion is essentially saying Powell committed defamation by making false claims and lies about their voting systems.

Instead of pleading to the judge to dismiss the case, why not break that barrier that we can't get through and proceed with the case to present your evidence and open Dominion up to discovery? It goes both ways, Dominion has to prove that didn't flip votes and Powell can also back up her claims with evidence to show that Dominion did commit widespread vote swapping.

Even the quote that WSJ used does not necessarily mean it was just her opinion, " “reasonable people would not accept such statements as fact view them only as claims that await testing by the courts through the adversary process" That statement doesn't mean her claims were not substantial, only that for people to take them as fact, they need to be proven in a court of law. Which is a reasonable claim on it's own. Also in the intro it stated "Finally, should the Court decide to address the Complaint’s substantive allegations, the Complaint fails to state a claim under Rule 12(b)(6)." which means they aren't arguing that she had nothing but opinion. I'm still reading through this, but everyone should see the primary source and make a decision based on that, not someone else's write up.

I can't stand Sidney "sErVeR rAiD" Powell, but the MSM's take on this is full of lies as usual, and is misrepresenting her. In short, the paragraph that people are quoting and misinterpreting is stating that she made public statements of her opinions and evidence supporting her opinions. In a legal sense, she would not characterize these opinions as statements of fact until after being proven in court. She expected that she would be able to prove her assertions in court or at least have an opportunity to prove them in court.

At least that's the argument I assumed she was making when I first read this thing.

If Powell is confident that her claims are true, in order to successfully sue Powell, Dominion would need to prove that their voting systems were secure and that Powell's claims were untrue, and thus, defamation.

Thus, I don't see a valid reason to drop the case if she wanted them open to discovery.

Fair point. I'm obviously not a lawyer so I don't know. She could just be in cover-her-ass mode? I guess the best scenario would be the case proceeds, but her defense is successful, and discovery uncovers a lot of incontrivertable evidence.

Basically, I think Powell got in over her head.

I think she had good intentions and a lot of passion, but was mislead.

I think a lot of it was from Lin Wood (she originally distanced herself from Lin Wood but then became very close to him) and that guy is honestly batshit insane in my opinion. She started being fed Qanon stuff on the internet about secret overseas servers, satellites hacking machines, international communist plots with Venezuela and even fell for the entire "seized servers showed Trump won 410 electoral votes" hoax (I made a detailed post a few months ago showing exactly how that hoax started and spread so far....it basically started from a poorly written 4chan post in German).

She then repeated this stuff in the media as fact, without even vetting it. Remember when people were wondering why Trump went out of his way to publicly distance himself from her? Now we know why.

Of course, that got so much attention from people. It was a lot more exciting than "Democrat strongholds in swing states kicked out observers, covered the windows, and harvested/manufactured fraudulent ballots."

People assumed that because Powell said it, it must be true and verified. Because of this, she gained millions of followers, media attention, and the donation money was flowing to her like crazy. I recall on here all the people donating $100+ each to her at the time and encouraging others to donate during the Kraken hype and how she was saying she was going to bring down all the communists.

Turns out, her lead witness that came to her about the whole international communist plot from Hugo Chavez and control rooms overseas lied about his entire background and credentials. Major red flag.

Now I think she's in "oh shit" mode and covering her ass. I recall she was goading Dominion to sue her before so she could open them up to discovery, but now she wants the case dismissed and it downplaying her statements saying they are opinions, and the public shouldn't immediately believe them. A far cry of how she was phrasing it before as if it was 100% truth and fact.

I have no doubt that there's some rotten things about Dominion, but she dug herself in a hole with some of her more sensational claims.

And as much as it annoys me to come to Powell's defense, I think that what knewter said is 100% correct given the legal context. And I think it's a legal argument that's been successful in past defenses in defmation suits.
