War is not necessarily inevitable, we can instead file for divorce, red states split from blue states to form their own country. Both sides would prefer that to war. The country is already split between those who value freedom and those who value communism, we can just make the split official, sign the papers, and be done with the other side forever. It's the mature way to deal when two sides no longer love each other. And face it people, New America without all the communists will be a better place than what we have now.

You are assuming the crazy ex-wife won't hire a bunch of thugs to kick in your door and take the house you agreed to live in when you split. The commies cannot leave us alone, it is antithetical to their religion. They cannot allow anyone outside their own beliefs to exist, especially not close enough for their own people to look over and see that an alternative exists. If we split, they will immediately begin tearing us down again. Clearing them out is the only way.
Problem is, Communism is a hostile infectious plague, it requires land to expand, and the ones in politics are far more Trotskyist. The other reason is that they wouldn't be able to support themselves when they're not piggybacking off our labor.

I don't think the feds care what is legal and illegal. Especially when it comes to what they conceive of as 'counter-terrorism'
