So the argument is there should be 3 different levels:
Rape while the person is awake and not drugged.
Rape while the person is drugged out on their own.
Rape while the person is drugged because the person who is doing the rape also drugged the person.
So the person got convicted for number 3 but the argument is he should be convicted for number 2 but number 2 doesn't exist as a law so they can only convict for number 1 if you can't convict for number 3. So, the feeling is that number 1 has too light of a sentence associated with it and number 3 is too harsh.
