It isn't a statistics-based concept. Humans have higher-order executive functions as a matter of biology. That's the entire reason why we have a more developed frontal lobe relative to every other animal on the planet.
You act as if having higher order executive functions is somehow a substitute for choice. That's where you're failing. You presume that the two guys who raped that woman just did so out of some base instinct. They exercise executive function and chose to commit the crime.
