No, the Republican controlled state legislatures are. They have the absolute authority under Article II to appoint whatever electors they want to. Rudy & Jenna went to all of them and showed them the evidence of fraud.

5/6 legislatures in swing states are controlled by Republicans. 2 of those (AZ & GA) have Republican governors too. They had the absolute authority to send Trump electors, but cucked out and sent the Biden electors anyway.

Don't blame it on the SCOTUS when our elected GOP state representatives had the absolute power and did NOTHING.

The idea is that it was always an uphill battle for Trump in his legal battles, but that the state legislatures where Republicans had total control did jack shit to help Trump and ease the SCOTUS' burden which meant that the courts had an excuse to deny the lawsuit because "see the Republican state reps don't want to overturn it either so we're not gonna overturn results in 6 states because that's too much."

For instance, in GA and AZ it is total R control - had the governors just refused to sign the certification of the popular vote in those states, the legislature would then appoint whatever electors it wanted. 232+16+11 = 259 at that point, and Trump would only need one state (PA) to win.

If GA & AZ would've done that and helped Trump out, SCOTUS would have no excuse about optics, legitimacy, or whatever since they would only have to evaluate the legitimacy of the election in only one state instead of 3-4, and there's precedent for that with Bush v. Gore in 2000. In fact, they don't even have to overturn PA for Trump, the SCOTUS just had to rule the conduct of the election illegal and void the 20 electors from PA, making it a 259-259 tie, and sending it straight to the House Delegations (27R-23D) and Senate (51R-48D) on January 6th.

My point is had the state legislatures even done the bare fucking minimum (not even too much - just 2 states would've had to overturn for DJT), then it would've made it easier for SCOTUS to jump in, void one state, make it a tie and send it to the House/Senate where Trump would've won. It would've been a much easier pathway for the SCOTUS and they would've had no "optics" cop out and been more palatable for the justices. It would've just taken 2 people [Ducey + Kemp] to refuse to put their signature on a page, and the R legislatures there to send Trump electors and it would all be great and dandy.

Don't know as much about AZ, but Georgia wasn't helped by their Secretary of State (the one in charge of running the election), claiming his people investigated all the claims Giuliani and Trump and that there was nothing to them.

Of course no one wants to admit they screwed up running an election.

Then Kemp would have had to deal with his capitol getting burnt down. Stacy Abrams would have led a mob to his doorstep. A mob in a uproar over this governor attempting to overturn the will of the people in this "legitimate election". (It must be legit, "Republican" Secretary of State Brad Raffensperger said it was.)

Unfortunately the SCOTUS was probably right not to take that case, at least from a strictly legal perspective.

We don't have a national election for the President, we have 50 state (and DC) elections. Thus Texas has little standing to bring a case over what amounts to another states internal affairs.

Where the SCOTUS was wrong was refusing to hear the appeals to the cases that were brought by the electors, legislatures, or people of those states. For example, on Dec 8, they refused to hear an appeal of a case that was decided by the PA Supreme Court.

Republicans had the chance to easily stop this illegal coup and count only the legal votes.

They decided to do nothing but just declare "most secure election ever" and "voting fraud doesn't exist"

That's why their current posturing and complaining about Biden right now is laughable. If they actually really cared, they could have stopped it and Trump would be sitting in the White House today.
