But to avoid the "I have a constitutional right to return as an American" arguement, the website specifically states something to the effect of "you aren't being prevented from coming back, you just cant fly back."

And sadly, this is one area of the law (protecting the border + biological threat) which is quite deferential to the government. Which... is exactly why this was the crisis that they decided to manufacture.
Unless you're vacationing in Cozumel or Cancun. From there, it would take you about 5 days to drive to the border.
