Nothing bullshit about this post . Noem vetoed it and the only reason she gave for 2 weeks was because of the fallout with the NCAA.

This bill was debated for 10 weeks and not a peep out of her. It took 2 weeks for her to identify the language she supposedly had trouble with.

As far as Noem and this site is concerned, the issue is too many people simping for her.

This is a good point. Over recently posted something about ted Cruz because a bunch of people were giving him unnecessary hate. A good MAGA person- someone we can get along with- didn't necessarily have to be for throwing commies out of choppers like some here. We can work with these people with out conceding our solid beliefs. No crossing the aisle! I'm not saying that, and I realize it's a fine line or perhaps I've already blurred the line; but we'll have to work with people who are 70% aligned with us. The movement will fail if we don't take everyone in.

I've got a slightly different take on crossing the aisle.

We are a MAGA movement, not a Republican movement. We will use the GOP because it's the most logical vessel.

But the MAGA movement welcomes independents and even disaffected Dems.

That's not crossing the aisle, it's recognizing that the aisle is a distraction of the Uniparty, and we're not playing their games anymore.

We can't fix the 2 party political system yet, but MAGA is a cultural movement, and politics is downstream from culture.

We need to coalesce around our common beliefs; Individual Liberty, Limited Government, and rooting out the corruption.

I heard a Gov. Noem interview on Bongino's show a couple days ago. She has said unequivocatingly she wants to sign a bill that protects girls/womens sports, but this one has serious flaws. She and others are touting the Tenn. bill recently passed as the model for how she wants the S.Dak. one written.

So, the legislature didn't have enough to override Noem's veto.. So the frick what?! Maybe they should knock off the powerplay, and focus on passing a bill with either the suggested changes, or make it a direct copy of the Tennessee law. Work together to get it done. Republicans have trifecta-control of both chambers and the governorship in South Dakota; why are they being idiots and turning this into some kinda fight? Why are they giving Democrats ammo for the next election ("See, Republicans hate women/girls. Vote for us... <blah blah>")???

Well, it would behoove us all to read: (1) the bill that was sent to Gov Noem's desk; (2) the specific suggestions she sent with the bill back to state legislature; and (3) the bills passed by other states (like Tennessee's law that Noem and legal folks say are stronger and cleaner).

Are you saying that she didn't include those objections and suggestions to the state legislature at the time she sent it back? And then 2 weeks later she added her reasons/suggestions? Or are you saying that she didn't explain it to her constituency til two weeks later?

Real annoyed with Bongino interview when he just didn't get it. She wants the bill written correctly, not just to do it. If you just pass some garbage written law, it will be struck down and waste everyone's time. Tennessee already has a bill to model after with good language, she wants that language. "we'll have to agree to disagree, I really want to at least start with garbage, so when it gets struck and you lose a lot of $$, everyone will feel defeated and give up. That's a good start."

She seems to be looking for more specificity in language used. She requested the specific revisions that would lead to her passing the bill. None of them seem prohibitive.

There is already legislation elsewhere in the country that has been passed which future legislation could be based on instead of a blank slate. This would also address her other concern regarding a “patchwork” approach which would effectively break collegiate athletics programs.

if you're talking about attending the inauguration, people like Hawley and Cruz attended too even though they objected to the electors on 1/6. They invite all members of Congress and governors to attend the event as dignitaries, regardless of whether it's a Dem or Rep getting sworn in. It's customary and goes way back. Yes, it would block trannies in girls sports, but it had all sorts of bad language.

Such as a player that failed to make any team could sue the school and all players that did make the team, up to two years later, if it were later determined a player that did make the cut, did so by cheating.

So imagine your some college kid that worked your ass off to make a team. Later, and completely unknown to you, some player on your team admits to using steroids. Every single person that tried out for, and didn't make the team, can now sue you personally because your didn't stop that person from cheating which denied someone else a rightful spot on roster.

I think the "style and form veto" she used is a cop out. I defended her a couple of weeks ago thinking she just had issues with the wording or something, and wanted to make it stronger, but I don't think that's the case.

She wanted it reworded in a way that essentially renders it meaningless. For example,

Weakens Section 1 dramatically by changing the operative language of the bill. Previously the bill stated: “A team or sport designated as being female is available only to participants who are female, based on their biological sex…” She wants that edited to: "“A team or sport designated as being female is available only to participants who are female, based on their biological sex, as reflected on the birth certificate or affidavit provided upon initial enrollment…”

In other words, under Noem’s proposed changes, a biological male would easily be able to participate in women’s sports in South Dakota (even in K-12) as long as he files the proper paperwork.

But even “biological sex” isn’t remotely bulletproof. My professor for my psych nursing class, with a DNP, stated clearly multiple times that if they have a “sex change” then their biological sex has now changed. So if a dude who had testosterone running through his veins for half a decade gets his dick chopped off, there is now plenty of literature stating that his biological sex is now “female.” And some states would allow, and fund, this type of operation in children. An 18 year old dude gets his sex change and at 18 1/2 can go play women’s soccer in college under that original wording.

Presumably, this requirement was included to address a student taking these drugs as a part of a gender transition, but House Bill 1217 is not limited in this way. Rather, if a male student athlete failed to make the football team, and later learned that another student on the team was taking steroids without disclosing it, the student who didn’t make the team would be entitled to sue both the school and the steroid-using student for damages.

In addition, Section 2 creates an unworkable administrative burden on schools, who under its terms must collect verification forms from every student athlete, every year, as to age, biological sex, and use of performance-enhancing drugs; and furthermore must monitor these disclosures throughout the year so that if “reasonable cause” is found of a false or misleading form, the school can take action to avoid civil liability.

I am also concerned that the approach House Bill 1217 takes is unrealistic in the context of collegiate athletics. In South Dakota, we are proud of our universities’ athletic programs, and in particular the great strides we have taken to gain national exposure and increase opportunities for our next generation over the past two decades.

South Dakota has shown that our student athletes can compete with anyone in the country, but competing on the national stage means compliance with the national governing bodies that oversee collegiate athletics. While I certainly do not always agree with the actions these sanctioning bodies take, I understand that collegiate athletics requires such a system – a fifty-state patchwork is not workable.

To achieve the legislative intent of protecting girls’ sports, while simultaneously avoiding potential unintended consequences, I recommend the following Style and Form changes to the Enrolled version of House Bill 1217:

Revise Section 1 to read: 13-67-1 Athletic teams and sports-–Designation by sex–Participation.

Any athletic team or sport that is sponsored or sanctioned by an accredited elementary or secondary school public school, a school district, or an association meeting the requirements of § 13-36-4, or an institution of higher education under the control of the Board of Regents or the South Dakota Board of Technical Education must be expressly designated as being:

(1) A male team or sport;

(2) A female team or sport; or

(3) A coeducational team or sport.

A team or sport designated as being female is available only to participants who are female, based on their biological sex, as reflected on the birth certificate or affidavit provided upon initial enrollment in accordance with verified in accordance with § 13-27-3.1 13-67-2.

Strike Section 2; Revise former Section 3 to read: 13-67-2 3 Complaint—Investigation—Adverse Action.

A governmental entity, licensing or accrediting organization, or athletic association or organization may not entertain a complaint, open an investigation, or take any adverse action against an accredited elementary or secondary school, or a school district, or an association meeting the requirements of § 13-36-4 or an institution of higher education, or against any person employed by, or a governing board member of, such an elementary or secondary school, or school district, or institution, or an association meeting the requirements of § 13-36-4, for maintaining athletic teams or sports in accordance with § 13-67-1.

Strike Section 4. The proposed revisions limit House Bill 1217 to elementary and secondary school athletics, which are primarily conducted among South Dakota schools and at the high school level are governed by the South Dakota High School Activities Association, a creature of South Dakota law. The proposed revisions will also remedy the vague language regarding civil liability and the use of performance-enhancing drugs.

Overall, these style and form clarifications protect women sports while also showing empathy for youths struggling with what they understand to be their gender identity. But showing empathy does not mean a biologically-female-at birth woman should face an unbalanced playing field that effectively undermines the advances made by women and for women since the implementation of Title IX in 1972. The Supreme Court of the United States has recognized that the Equal Protection Clause of the Fourteenth Amendment allows for the law to treat women and men differently, and in this instance that equal protection afforded women absolutely should apply on our state’s elementary and high school playing fields.

I support this legislation and hope that House Bill 1217, with the changes I am proposing, becomes law. I respectfully request that you concur with my recommendations as to STYLE and FORM.

I still am going to reserve judgement on Noem. Based on the wording of her statement, it sounds like the assembly in SD got the bill back for correction, and instead of working on the bill to get it to conform with what Noem wanted, they tried to get the existing bill through on a super majority vote, which failed. She straight up said at one point, "Give me something that looks like Tennessee's bill." They just wouldn't do it.

Noem has to take a hit for being vague about what she objected to in the bill. She may be doing that in order to avoid legal complications. The assembly has to take a hit for trying and failing to take the easy way out.

I really don't like seeing this leftist-style railroading happening on our side. It's warranted when someone CLEARLY betrays our trust (see: Mike Pence, Amy Coney-Bullshit, Brett Kavanope, Fox News in general), but I don't think that's what's happened in South Dakota.

As far as corporations go, there aren't major ones headquartered in SD and their locations are extremely far from each other. SD consumes a lot of sports for entertainment. Retailers don't have much pull, SD has no major theme parks, and sports corporations have some influence. You don't need to have four or five major stadiums for people to consume sports.
