The Constitution never even considered this. The Supreme Court can't rule on a law that doesn't exist.

The only thing they can do is accept the validation, right or wrong, made by Congress.

It may piss us off, but this is a small price to pay to live in a country where government officials pledge fealty to a document instead of a king.
