You also have to PROVE that due to the defamation and slander, that you were negatively impacted financially, employment, physically, mentally, emotionally. Which is a rather high bar to clear in a court of law.
You can't just sue willy nilly. It costs money to file lawsuits on top of it being public and thus on the radar (optics) plus the courts get really irritated with frivolous lawsuits and will start sanctioning the lawyers or label you as a vexatious litigant.
This was the only area our founding fathers fucked up. They gave way too much leeway to defamatory speech with almost no recourse.
The current state of our media illustrates it perfectly. If the onus was on the publisher or the person making defamatory statements to prove they have evidence then this shit would all go away. Instead it’s up to you to prove that they knew they were spewing lies, but all they have to say is they actually believe it and that’s a valid defense. Case dismissed.
