Cuz all it takes is the wrong judge. Which is why the 1776 Rights we read about are not POLITICALLY real in a politicized government and judiciary: your freedom from jail depends on the political agenda one judge has as he/she presides over your fate.

Those Rights are not a thing when the consensus of those in power say they are not. It is just a random judicial glitch if you happen to not serve any time for having taken a stand for your Natural Rights like he did.

If we were doing it right, we would have good counties and courts calling habeas corpus to free people like him from injustice. He would never be allowed to return to that jurisdiction, but he would be a free man otherwise.
