This is defense exhibits 6 and 7 in the motion to dismiss charges against Thomas Lane, one of the officers responding to George Floyd's crime....

*Regarding the pictures presented first: *

These images show evidence that George Floyd knew he was using counterfeit currency and was attempting to conceal it from officers. This speaks to his evasive state of mind and the grandiose attempts to avoid arrest and prosecution that followed, precipitating the need for police to use force.

Bills are crumpled and crammed into small spaces in a hurried attempt to hide them. You and I know this is a pathetic attempt but George was high on a fatal dose of fentanyl and meth.

*Regarding the Minneapolis PD Manual: *

  1. Officers were attempting to affect a LAWFUL ARREST
  2. George Floyd's behavior and actions, demonstrating a state of Excited Delirium, was consistent with the definition of Active Resistance, creating the need for forceful intervention to lawfully bring him into custody.
  3. The Neck Restraint method used by Chauvin is a non-lethal technique described precisely in the Minneapolis PD training manual.
  4. The medical examiner's autopsy for Floyd showed no sign of asphyxiation or pressure applied to the trachea or airway. Floyd died of heart failure. The Floyd family's own private autopsy claimed asphyxiation. How convenient, but not an unbiased or official autopsy.

Did the Neck Restraint technique used by the Minneapolis PD, in which Chauvin was trained and employed accordingly, complicate Floyd's lethal dose of fentanyl and contribute to heart failure? For argument, let's say it did.

Derek Chauvin was performing his duties as he was trained. He personally had no way or method of knowing Floyd had chosen to ingest a lethal dose of THE most dangerous drug. He had a DUTY to arrest Floyd using the techniques AND ONLY THE TECHNIQUES provided to him by the Minneapolis PD. An officer applying non-approved techniques would endanger themselves, other officers, and possible the public. OFFICERS HAVE A DUTY TO FOLLOW THEIR TRAINING.

Derek Chauvin did his job. The fact the Floyd chose to ingest large amounts of drugs, chose to knowingly commit a crime using counterfeit currency, knowing that this could lead to arrest, chose to attempt to conceal his crime from police, and chose to resist arrest, IN NO WAY is Derek Chauvin's fault.

Whether or not the Neck Restraint technique should be used is for LE specialists and PD department administrators to decide, NOT DEREK CHAUVIN.

Derek Chauvin is innocent of the charges against him.

*Having nothing to do with the legal arguments of this case: *

Criminals must bear the responsibility for their own actions. A free and just society presents individuals with choices and consequences. You cannot have both freedom of choice and freedom from consequences; it will always result in tyranny of the worst actors.
