Attempted extortion is still a crime and this asshat should do some time for that. The sentencing guidelines for actual extortion are substantially greater than attempted extortion. However, I am willing to bet he was not a lone wolf, and there is a conspiracy to commit extortion here. Along with interstate wire fraud for using whatever phone calls/emails.
