Update: he easily won in court, the HOA then proceeded to ban him from "all use of any and all of the common facilities for a period of one (1) year" for no other reason than they were salty they couldn't kick him out of his home
I despise HOAs as much as anyone. I lived under one that wildly swung from neglect to gestapo nazism and back at least twice in the twenty years I was there.
That said, it is not difficult to find a place without an HOA and covenants. Just make that a criterion in your next house search.
If you worry about missing out on amenities like swimming pools, tennis courts, and the like, some older HOAs will let you buy into using their facilities since interest in these activities have been declining steadily over the last couple of decades.
HOAs need to be outlawed. The ones that call themselves HOAs but really only collect a nominal fee yearly to upkeep a common lake or recreation area, fine, but the moment they start enforcing contracts governing what you can do on the property you are paying for, no. They will bitch about everything from the "Approved colors" houses can be, to the exact type of mailbox you can have, if you have a fence around your yard, they have to approve it, the color, height and material...
But this BS, now they dictate the kind of car you can have? I can see people complaining if they guy had shells of old rusty cars all over his yard, not only an eye sore, but could hurt the property values a bit seeing as no one would want to buy property in what's supposed to be a nice area and they have to look at the junkers on a guy's lawn...but the HOS should have no part in it. There should not be a council of neighbors who can dictate what you do with the land you're paying the mortgage on.
I hate HOAs and would never own a property in one, at least not to live in myself, but people have freedom of association and should be able to partake if they so choose.

I would never buy a house where I pay for it and taxes but the HOA actually owns it since the HOA has control of it. HOA is a rip off anyway.
