Then he was lying.
He was, but it was careful half lying coached by a team of experienced lawyers. Upon being pressed he clarified that he felt the length of time in that position is what constituted it being against policy because the policies carry a lot of subjective language like "as necessary." He stated his position as fact during direct but it turned out to be uninformed (at best) speculation.
The purpose of this interview was to create headlines. The MSM is only reporting prosecution approved statements from direct and pretending that cross never happened. They're trying to maximize anger and violence upon aquital.
