The markings on the selector (fire/safe/whatever) are not an indication that it is a pre-ban AR. In fact, it's extremely unlikely that it's a pre-ban AR, and much more likely that it's simply safe/fire/nothing-at-all.
You can mark the lower however you like. It's only select-fire if the mechanical side works, and it's extremely unlikely that's the case here (because it would have to be a retrofit on a pre-ban AR or M16 to be legal).
You can order an AR lower that says "siesta/fiesta/donkey show", but it won't bang-bang-bang if you flip the selector to the third position. It's just a joke.
