Now, if someone were to get any of those tools and they work contrary to their use and actually cause harm when the intention isn't to cause harm (negligence aside), then I'd assume yes the manufacturer can be used.
A vaccine is meant to be something that provides a health benefit for the person taking it. If the vaccine does something contrary to its designed use and actually harms the person, then yes, legal action should allowed to be taken.
