Totally ruled out by every medical expert to testify so far. Prosecution has like 4 more to go.

We'll see if defense can get anywhere with that idea.

Really? Dr. Google tells me that one of the symptoms of a Fentanyl overdose is a weakening of breathing, possibly leading to breathing stopping or hypoxia. Hmmmmm.... Interesting that he said he couldn't breathe while he was still standing up.

Fentanyl OD causing death puts you in a coma before you die. GF never went into a coma. Per medical expert testimony so far.

Also GF's respiratory rate was 22 breaths per minute, as high as can be considered normal for him. Totally impossible with fent OD death.

GF saying he couldn't breathe is irrelevant, as he continued to be alert, struggle, and able to speak for many minutes.

He was high AF, but not OD death. Again, we'll see if defense can get anywhere with this point. I don't think he'll try.

So: I can't breathe is irrelevant. Seems appropriate. Who was counting the respiratory rate? Are we only relying on the expert witnesses of the prosecution so far? Cause those are never biased. Who said it was an OD death? There was many contributing factors. The only thing the defence needs to do is cast reasonable doubt on whether or not Chauvin caused the death. Of course the prosecutors "expert" testimony will say that he did.

Dr Tobin, leading Dr on the physiology of breathing. Nobody has more experience than him. Contacted by the State, not paid.

He showed his work. Counted breaths from video, right in the Courtroom. Incontrovertible evidence, I think.

Not "relying" on anything. The trial isn't over. A LOT of information has come out in 2 weeks, after no info since June. Defense attorney is clearly stunned by some of it.

Any bias or lies by witnesses for the prosecution is up to defense to flush out. I'm only bringing up what all of them agree on and has stood up to all questioning. I don't think defense will even try to challenge any of the medical info here, but I think he can make headway on what Chauvin was authorized to do by law, procedure, and training.

We'll see.

Baker, medical examiner who did the autopsy, made cause of death very simple. Drugs played no role. Heart disease was a "significant contributing factor," but not the cause. GF never had a heart attack, ever. Incontrovertible evidence there. Police "subdual, restraint, and compression" is the cause of death. Period. I don't think defense gets around this.

Wrinkles:

  1. Chauvin wasn't there when GF was handcuffed. The individual cop to cuff a perp is responsible for their care.

  2. To start CPR, cops wouldve had to remove handcuffs. Was that safe and reasonable?

  3. The idea that GF should have been rolled onto his side or sat up, what does the law, Chauvin's training, and procedure say about this? All cops to testify so far present this as being very clear cut. I think maybe defense can poke holes in this, and/or show it was never safe and reasonable to try.

Chauvin's big problem remains 4:44 when GF was unconscious or dead and he never changed his tactics.
