It doesn't surprise me he joined the anti-Church side. It only surprises me that Roberts sided with the minority. I've heard it said that Roberts likes to be on the majority side of the court in every case, whether it breaks in favor of conservatives/the constitution or against them. It seems odd to me that Roberts would see that the conservative wing would outweigh the left side of the court and he would still choose to pick the losing side.
