The incident ostensibly began after an officer believed Nazario was driving on U.S. Route 460 without a rear license plate, according to the lawsuit. While the SUV was new to Nazario, meaning he hadn’t gotten permanent plates yet, he still had a temporary plate taped to the inside of his rear window, the lawsuit notes. The temporary tags are visible in the body camera footage.

Nazario slowed down his vehicle within seconds of the police pursuing him and activated his turn signal. Because it was dark, Nazario also drove for less than a mile—below the posted speed limit—until he reached a well-lit BP gas station, where he pulled over. In all, it took about 1 minute, 40 seconds for Nazario to pull over after Crocker initiated the stop, according to the lawsuit.

Still, the cops claimed in a report Nazario was “eluding police,” had a dark window tint, and lacked plates, so officers treated the incident as a “felony traffic stop,” or a traffic stop they believed to be risky. One of the officers admitted later that they knew why Nazario had pulled into the BP—it happened all the time, and was a maneuver often used by people of color, according to the lawsuit.

Also, after being signaled to pull over, he [Nazario] drove for 100 seconds before stopping. Close your eyes and count for 100 seconds.. That's a long time and is definitely considered eluding. He also didn't listen to their commands to get out of the car. Everything he was taught to do in a situation like this, he did not do. He is at fault.

I watched the full video. I saw no dealer temp sticker on his back, or side windows. It took police five minutes to get him out of the car, as he refused repeatedly so was pepper sprayed. He was told to get on the ground. Two minutes later he had to be forced to the ground. He was not beaten, but the police said he fucked up (not obeying orders). He made a fool of himself. Everyone in the military knows to follow lawful orders (except him) !

He didn't have plate on his car, and the officer's didn't see his paper tag on the window. But in any case he went "black" on the cops, became argumentative, and refused to exit the car. What could have been handled without an incident turned into one because of his attitude. This guy isn't intelligent enough to be a 2nd Lt. It's dumb to go off on a cop, and it leads to what ?

OMG ! They didn't salute him. You do know the correct term for a policeman is "Officer" , and when a Major calls a 2nd Lt. He just says "Hey you" !
