It’s reasonable to expect police to differentiate between lethal and non lethal weapons 100% of the time. It’s a low-tier homicide crime and she needs to be fired, lose her retirement and do a little bit of time.

A person is dead because of her accident. And yeah, daunte should have listened, should have paid his warrant and not been a low level criminal. All true.

But what he deserved was a lightning bolt up his ass from a taser and a few new charges, not a death sentence. She still has to be held accountable.

The bodycam murder of Tony Timpa by Dallas police officers is what should be in the news. The entire footage needs to be seen by everyone. The anger of the paramedic at the end, and the officer asking if they had killed him while other officers mocked Tony should be viral. The real kicker is that he called the police on himself.

That didn't seem all that bad to me. They didn't use excessive force and they seem to know him personally, they even called his mom on the phone, so they are familiar with him hence why the joking probably happened. They did check his breathing multiple times and repeatedly mentioned it.

Yeah, the joking was a bit excessive, but makes sense if they were on first name basis with him. The video I watched said the paramedics administered a powerful sedative and not Narcan, one officer even asked if it was narcan and they said no, it was sedative. If true, it was likely the sedative that killed him and made his central nervous system shut down and then breathing stops.

What exactly am I missing?

That could be if it was a cherry picked body cam. The paramedics did sound pissed. But it didn't seem like the cops meant harm or wanted him to die at least from the video I saw.

I think the video of cops murdering the young guy on his knees in a hallway after screaming they were going to kill him and giving conflicting orders, all while the guy is sobbing and begging for his life, is far more indicative of major problems with police violence and immunity from their actions though.

Man, this dude was initially pulled over for a seat belt violation. I understand his frustration. I always wear mine because I believe I understand traffic safety but here is another "excuse" for cops to pull people over.

Obviously the dude should not have got violent but this whole scenario would've been avoided if we as a people would've pushed back against these bullshit laws that infringe on our freedom in the name of safety. We are so fucked because of the incrementalism of it all.

That said, cops need to know which weapon they are using and if they can't keep it straight should be held accountable and suffer the consequences just like people are expected to suffer the consequences when they don't wear their seatbelt and then decide its a good idea to body slam and officer over it.

I have a ton of respect for this guy. Even though I think this is an open and shut manslaughter on the hands of the cop here, he did the right thing by calling for due process. He should sue for wrongful termination. It's his job to ensure there is some kind of review process anytime someone wants an officer fired. It's highly likely that the review process would have resulted anyway in her being fired, but you don't just get to skip to the end.

I understand Duante Wright was not an angel. I'm not at all saying Wright was in the right here or anything to that effect. The video clearly shows he shoved off a cop and dove into his car. A reasonable cop could have assumed he was reaching for a gun tucked under the seat or something. I fully understand that. But when a cop says "taser, taser, taser" while pulling out her pistol and shooting Wright, that seems like a clear example of "she made a mistake which resulted in the death of a person."

In Minnesota, second degree manslaughter is defined as "a person who causes the death of another by... the person's culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another."

The cop was negligent in that she pulled her pistol instead of her taser and Wright died as a result of her actions. I guess a court case will have to explain what "consciously takes chances of causing death..." means here.

It's already being reported the cop will be charged with 2nd degree manslaughter, so I'm not way off base here saying that is the likely charge. Im no defense attorney but I don't see how, given the facts of this case, you really argue that she didn't kill Wright by accident (manslaughter). If the defense is, well she meant to taze a suspect resisting arrest but accidentally pulled out her gun instead, that would seem to directly affirm manslaughter here, would it not? If I'm missing something please correct my thinking here. I'm not trying to eagerly condemn someone without due process, I'm just expressing my opinions on the case and the relevant law as I see it.

She honestly might. If she had known she was pulling out her pistol when she fired at Wright, she could have conceivably argued Wright was resisting arrest, fighting with her fellow officer, potentially grabbing at his belt or going for his own concealed weapon. There's enough erratic movement from Wright in that video that she could make that defense if she had knowingly pulled the pistol.

IIRC, the cop who shot Jacob Blake is literally back on the force now because his actions were both justified and intentional.

But in the video this cop clearly, audibly and repeatedly says "I'm going to taze him" and then says "taser, taser, taser" and after she shoots she says "oh shit" like she realizes she grabbed the wrong thing out of her belt. Shooting Wright may have been justified, but shooting him was not her intent, meaning her accidental actions caused a death. Generically speaking, when someone has an accident that gets someone killed, that's usually called manslaughter (again, speaking generically and not specifically in this exact case).

Now, maybe this could be dismissed as a no-fault accidental death situation but I doubt it and the cop had already been charged with second degree manslaughter. I think the evidence is strong enough to earn a conviction on manslaughter in this case and I'm not really sure Wright's actions here could negate that. It's clear the cop did not premeditate murder or even attempt to cause the kind of harm that would result in murder, so it does seem murder 2 or 3 are not appropriate here.

If I'm totally off base, feel free to correct me. What do you think are appropriate charges, if any, in this case?

Sounds more like Daunte killed himself by creating the risk when he committed a crime and attempted to evade arrest, necessitating the officers to draw their weapons.

Duante creating an unsafe situation doesn't negate the cop pulling out and using a gun instead of a taser. It's tragic. Wright is not "in the right" here and he's not innocent. But his stupidity doesn't absolve the officer of the mistake she made. The mistake is obvious too as she is essentially narrating what she believes are her actions (to taze a suspect) before realizing she pulled the wrong tool from her belt.

A gun would have been justified. She meant to draw a taser, so what? The mistake achieved the same result of stopping a woman-abusing criminal from escaping to terrorize more women.

If I'm on that jury and then it's going to be a not-guilty from me.

I'd call her a coward but If I was in her shoes, knowing my kids, my husband, my career, my home and my life, would be in danger for not voting to fire Boganey, I honestly don't know what I would do. Boganey kept his integrity, no doubt, but I think most people, like Lawrence -Anderson, will chose safety over integrity. I am so glad I am not in the position of authority where I'd have to chose between doing my job with integrity and being a coward to avoid the mobbing.

People are idiots. Just because you think that people should be afforded their constitutional rights does not mean you condone what they are accused of. These people are so quick to call for the release of death row inmates like Rodney reed or mumia whatever his name is, even though there is overwhelming evidence that they are guilty.
