Wouldn't this mean the other police officer who thought she had a taser should not be charged with anything either?

"He was not in fear for his life, therefore he can shoot whoever he wants" is the most bullshit statement I have ever had the displeasure of reading from a governmental body.

Based on the logic of the DOJ, anyone who entered the building could have been shot and killed and the shooter would walk.

I understand some people might claim a stand-your-ground argument - if you trespass you can be shot. There's a huge difference between a person's home and a building where the cops actually greeted people as they entered and took selfies with them.

If I have a dinner party and shoot all the guests I invited into my house, I couldn't justify that with stand-your-ground.
