This is so stupid. Stop letting people discourage you from protesting. You haven't even tried it. If you can't convince people to protest, you will never convince them to fight in a civil war.

Read Ayn Rand's book Atlas Shrugged. They need public consent. Protesting will actually disrupt their plans, greatly. Their propaganda also relies on people believing that the majority wants what they are doing.

If you want to protest successfully. Remember a few things:

  1. Set some goals for your protest. You have to have demands. Things that you want to happen.

  2. Do not stop protesting until your goals are met. If you stop, you've proven you're not serious and you will never get anything.

  3. No violence. Any violence will be used as impetus to crack down on you and lock you up.

If you won't protest. Be honest with yourself and realize that you won't fight in a civil war either. In fact, if you don't protest, it is an admission from you that you have surrendered completely.

No, it doesn't. The Constitution doesn't give a number for the quantity of SCOTUS judges. It would need 60 Senators to vote in support of it, but it wouldn't need to be ratified by any State Legislatures.

Same thing with the number + structure of lower courts. Congress can change that by a simple act.

Congress can also by legislation strip the lower courts of jurisdiction on certain matters.

  1. 1789: George Washington: initially established much of the judiciary, lower courts and established 6 justices, of which 5 would randomly hear and decide a case.

  2. 1801/1802: Reorganized the lower courts -- This was known as John Adams' Midnight Appointments. 5 justices (1 CJ + 4 Assoc.) Repealed under Jefferson and restored back to the 1789 Act.

  3. 1866: Post Civil War under Andrew Johnson -- 7 justices, It said the POTUS couldn't make an appointment until number declined to 5, at which point he could appoint 2 more, and a quorum would be 5/7 justices.

  • Johnson begrudgingly signed this; it meant he tied his hands on SCOTUS appointments. He signed because Congress was veto-proof Republican at the time [they had 70% in both Houses] and his veto basically didn't mean jack shit. Congress overrode his veto on basically everything and Johnson and Congress hated each other at the time.
  • It was done since there were vacancies at the time, and Congress didn't want Johnson to appoint CSA loyal justices to the court.
  1. 1869: Ulysses Grant -- sets the number to 9; is the most recent time number has been changed.

  2. Various Judiciary Acts have been enacted since then, either changing the lower courts, their composition, salary of the SCOTUS, etc. But none since 1869 have changed the number of the SCOTUS.

The number of Seats were changed through an act of Congress numerous times...it went from 5 to 7 to 9 to 7 to 9. Congress actually reduced the number at one point to prevent Andrew Johnson who was on his way out the door from naming any new appointments. The most recent time it was changed (increased to 9) was in 1869, under Ulysses Grant.

It requires an act of Congress, not necessarliy an amendment.

The House is only involved in impeachment & salaries when it comes to federal judges.

I think you're referencing the Judiciary Act of 1891 but that was agreed upon by all justices at the time and that was not limiting the power of the Supreme Court because those judges serve under the justices.

Technically, by the letter of the constitution (as interpreted by the Judicial Branch) the Legislative Branch has power of the Judicial. They can set the number of Justices and they set the form of the lower courts, including, if they so wished, completely abolishing them. TBH, what I expect out of this is that they pack the lower courts. What most people don't realize is that 60-70% of Supreme Court cases go 9-0, the Justices are much closer than people pretend. Also, they have Original Jurisdiction over VERY LITTLE, so they only hear a small amount of cases per year. The biggest difference to society at large, particularly in the form of criminal law, would be to pack the District Courts and the Circuit Courts. Most people don't even know what that means, and wouldn't care, but when every Circuit is the 9th Circuit, there is no Split in the Circuits to persuade the Supreme Court to Grant Certiorari to hear cases.

I don't expect the Biden to pack the Court, but I do expect him to pack the courts.

Opening a convention of the states in such a tumultuous time is ultra dangerous.

The powers contained within dwarf all three branches of the federal government put together, by magnitudes, and the chances that extracurriculars take place when the articles are open for review is very high.

The entire nation could be 'legally' eviscerated, and don't be surprised when it happens when and if the convention is convened, because nearly every level of government which would need to be involved is corrupted beyond any hope of recovery.

Yeah...this is one of the things Scalia warned. A Convention could not be limited by Congress or by the several States to any one topic. You need 2/3 to apply for one, and 3/4 to ratify any amendments.

So theoretically they could apply for a convention to pass a Supreme Court justice cap amendment, but the actual Convention doesn't have to be limited to that...it could do anything such as repeal the whole bill of rights or dissolve the United States entirely or make the president a totalitarian dictator.

It has never been done, so nobody really knows what it looks like. Some have argued a narrow means of a particular subject matter. Others have argued predetermined amendments be floated to the states to be voted on which would determine which ones would be the discussion at the convention. All Tulammo ive ever shot has been pretty good. I generally try to use brass or aluminum cased ammo but the steel cased stuff is good for just fucking around with. The only problem ive had with it is in my S&W 686 .357 mag. It fires fine but gets stuck in the cylinder. Even if you slam the ejection rod it still wont come out. I guess its just the way the steel expands when fired...
