We need a Constitutional amendment to provide that the only mechanism for changing the number of SCOTUS Justices is:
-- adding (or eliminating) 2 seats at a time (with eliminations to be made only by death or retirement of sitting Justices)
-- requires a unanimous vote of the sitting Justices
-- a Presidential election and inauguration of a new or re-elected President must occur between the unanimous vote for a change in number
-- a minimum of 10 years must elapse between changes.
There may be situations where the workload is too much for 9 Justices and there's a legitimate need to increase their number, but if all the sitting Justices can't agree on this need, then it isn't a real need, and is just motivated by a political agenda. There may also be situations (probably after one or more increases from the current 9) where the workload has been reduced and is expected to remain reduced for the foreseeable future, and the sitting Justices can all agree that a reduction is warranted in the interest of promoting the historically collegial nature of the group. But there is no possible situation where there would be a legitimate need for Congress to change the number of Justices in either direction, because the Congress is inherently politically motivated and has a short term view.
