Most of these incidents of police shooting also have followup cases in civil court, the burden of proof needed is also significantly lower a lot of the time. Quite a few of the "big" cases where the defendant is found not guilty, end up having some sort of civil damages verdict later on.

OJ Simpson is an example, civil court held him responsible.

If I was in his shoes, had an embassy or other governmental building to protect, and had to deal with an immediate attack, I would pick my defensive seat and allow nobody past.
