Chauvin did commit "criminal negligence". I would have charged him of that. It's important to admit his total negligence of a clearly overdosing man who lacked oxygen in the bloodstream because of the drug.

It's not that he couldn't breathe. He said that because his oxygen level were going down. He could have all the pure air of the world he would still have said "I can't breathe." It was stopped from going into the bloodstream by the fentanyl.
Floyd is in the car, window down, Chauvin is outside looking in and Floyd is extremely anxious, agitated and says "I can't breathe". Chauvin gets him out and observes his eyes and says "you are high?" or something like that. So he knew his condition.
That also explains why Chauvin didn't really care later when on the ground Floyd repeated again "I can't breathe". Fentanyl was doing the larger part of it.
