Lacked standing...how do you get standing? An entity that is suffering from inflated health care costs sues - no standing.

I'm not a lawyer, but I have a memory.

Let's all remember that back in 2017, GEOTUS told us flat out that Obamacare is dead. It's over. So I don't know what the Democrats and the media are all up in arms about today, but there is no more Obamacare.

What we have today is vastly different. Do you think that under Obamacare our premiums would be down for the third straight year??

Nope.

Do you think that if Obamacare was still the law we'd be getting COVID vaccines for free? They'd charge us a fortune!

Trump saved us from the abyss, and I think people forget that a little too quickly.

What we need is to go back to the way things used to be. Either get a job with insurance or go to the emergency room.

What we absolutely will not do is allow Democrats to push us back over the cliff and socialize how our medical industry is funded. My tax dollars should not go to buying Tylenol for anyone who can't afford a job.

Socialism does not work.

Show me one program where you can have people pay money into a slush fund for others to take and have the payers benefit. No implementation of it has succeeded in the history of the world as far as I'm aware.

Ponysoldierpatriot 1 point ago +1 / -0

The problem is the insurance companies are no longer offering the policies that they were pre Obamacare. I have employer based health insurance and the deductibles are so high, it is pretty much worthless. I have a $5,000 deductible for a single individual, and I have yet to hit that deductible. At most I have hit $2500 to $3000 and that basically means that I had to pay everything out of pocket. Sure, I could pay $300 a month and upgrade to a policy with a $1500 deductible, but I would still be spending more in premiums/deductible then just paying out of pocket.

It's constitutional for the federal government to require that you spend your money to purchase a product from a private company or pay a fine?

24
ShyRipley 24 points ago +24 / -0

iT's a TaX nOt A FiNe!

17
victory2024 17 points ago +19 / -2

The problem is that the GOP eliminated the fine a couple of years ago, so it's impossible to show that you've been harmed now.

10
SowellWasRight 10 points ago +10 / -0

The fine still exists on paper, they just reduced it to zero. Once again, it's Roberts that decided it was a tax, not a fine, creating the argument that allowed it to slip past the obvious unconstituionality. Now we have a requirement to buy stipulated on a "tax" of zero if you don't.

8
TheOutlawPepeWales 8 points ago +8 / -0

That was Alito's point. How can it be a tax if you don't have to pay anything? You know, that reminds me of an incident one my cousins had long ago. He got a minor traffic ticket and eventually wound up getting fined $0.00. They kept sending him letters saying he was going to get hit with additional fees if he didn't pay, so he mailed them a check made out for $0.00 and they finally let it go. That's government bureaucracy for ya. My point is, maybe that's what somebody needs to do to get standing - just send the IRS a check for the non-existent tax.

24
zkSfp 24 points ago +25 / -1

This is the correct answer

23
resoluteAction 23 points ago +24 / -1

Negative. Thomas concurred with the dissenters that it was unconstitutional but he refused to accept the political blowback of ending Obamacare. It is clearly unconstitutional and Texas clearly had standing. The SC is doing whatever it wants illegally.

5

There's the 10th amendment, but that's been dead since the supreme court murdered it with wikard vs filburn.

-7

get angry at the interstate commerce clause...should keep the industry or activity within state lines only if you want to escape the feds and not try to have your cake and eat it too by taking advantage of trading with other states and expecting to escape the interstate commerce clause.

2
BeefyBelisarius 2 points ago +2 / -0

Wikard vs Filburn stretched the commerce clause to also apply to commerce taking place within a state. And also to non commercial activities, the defendant in the case was a farmer who had grown extra grain for his own use.

1

Texas and "lacking standing" name a more common duo.

9
HuggableBear 9 points ago +13 / -4

It's a correct ruling.

Trump removed the portion that caused it to be unconstitutional, therefore they were arguing that the law was unconstitutional based on a provision that is no longer there.

If Biden puts it back into place, the lawsuit will be brought again.

10
victory2024 10 points ago +11 / -1

Nah if it goes back into place, then Roberts 'it's a tax' precedent takes effect again.

0
President_Elect_Pepe 0 points ago +4 / -4

Nah.

It’s just a clusterfuck 6 conservative judges don’t want to touch.

Trump didn’t remove shit. The executive branch ignoring the legal necessity for you to pay something has nothing to do with the law, as the law is effectually in place.

Heard that old chestnut about if you owe the bank 10k, the bank owns you, but if you owe the bank 10M, you own the bank?

Same concept applies to economies. We'll never nationalize health care. Too many people would be out of a job. What we'll do is, nationalize health insurance.

So we get the worst of both worlds. Yay.

14
Peppers 14 points ago +14 / -0

If you owe the bank 10k, you've got a problem. If you owe them 10 million, it's their problem

7
deleted 7 points ago +7 / -0
18
DestroyerofCobwebs 18 points ago +18 / -0

Lots of ways to answer that. The best answer though, is that it fucking doesn't. If you and the hospital/lab were able to negotiate the price prior to the scan, you could probably get out of there for a couple hundred bucks. But the mafia, er, health insurance companies, have forced health care providers to deal with customers the same opaque way insurance deals with the provider.

So here we are. You get shaken down after the fact for some unknown amount, the insurance company swoops in to pay itself some inflated charge, and your copay ends up being roughly the actual price of the service performed.

"Aren't youse happy we are here to protect youse?"

0
deleted 0 points ago +4 / -4
8
DestroyerofCobwebs 8 points ago +9 / -1

Sorry for your troubles. You answered your own question, though. Even with insurance, they're still billing you for everything you've got. The insurance companies are what allow that practice to take place. Insurance is the reason, the sole reason, why medical costs are not constrained by market forces. Allowable and ineligible? That's basically the fence telling the thief what stolen merchandise they will and won't pay for.

If it were not for insurance companies, the cost of your procedures would be constrained by what people can pay. And you would be able to know what that cost was, before you incurred it! What a novel concept!

Medical providers are not blameless in this mess, not by half. But it's the insurance companies that have severed the relationship between doctor and patient. They are the primary responsible party for our out of control medical costs.

Well, that and Americans who won't take care of themselves.

The average cost billed to insurance companies is 2500.00 for a CT scan in most of the USA. Cash customers usually negotiate lower. Most who pass through the machine without insurance will never pay the bill. Many who do have insurance will skip out on their co-pay portion to the hospital, and state/federal subsidized health care (medicare, Tricare, medicade, etc) will refuse to pay anything more than maybe 30% of the bill.

But let's pretend literally EVERYONE who passed through the machine paid their 2500.00.

The typical 64 slice CT machine, install, and maintenance contract costs run about 1.5 mil each, a 300k/year ongoing contract fee, and have a typical lifecycle of 10 years. The staffing and ancillary costs to run it are probably another 300-500k year.

In other words, they had better hope literally everyone remits payment, and they can run at least 3 people a day, every single day of they year without fail through it. this is less about the cost of the machine in reality, and more about the fact that you are footing the bill for a LOT of people who, for various reasons, will not pay their "share" of the cost of the service itself. The next time you are sitting in an ER waiting room, remember that you are likely paying the bill for those sitting around you as well.

2
MrAnderson1776 2 points ago +2 / -0

Because you can't shop for price with CT scans.

2
IthoughtIwalked 2 points ago +2 / -0

Trump supposedly enacted some type of price transparency where hospitals were supposed to list their actual fees for specific services. The idea was so that you CAN shop for price of a CT scan, and hopefully introduce some competition.

2

When the Executive branch cannot get what it wants, it simply becomes the Judicial branch, got it?

General Reminder: During the Civil War.... Lawyers, Judges, and Politicians were the first targets.

No journalists?

6
GenericInsult 6 points ago +6 / -0

I don't think so (at least not that I can confirm).

Thing is, back then, they were actually journalists. What we have today, are nothing more than politically motivated minions.

That’s the upcoming civil war.

Commo is the first thing to be taken out...

Comey Barrett and Kavanaugh- I wasted so much energy caring about them getting confirmed.

my fiance's mother has pretty much never worked in her life, is about to be 65. been on medicaid for decades now. She has so many terrible health problems too, probably costs tax payers at least $250,000 a year in medical bills. She pays zero dollars and bitches all the time about her healthcare.

Now my parents just retired after both working pretty good jobs for 30+ years each. Their healthcare costs to include medication is like 30-40% of their total income, even though they make a decent chunk for being retired. They've been paying taxes and their own healthcare for so long now, and ppl who havent ever worked in their fucking lives get the shit for free. my fiance's mother even gets $800 a month from the govt via SSDI, even though @ 62 or so when she got it, she had worked only 8 years in her life. Shit infuriates me.

6
Ocineaa 6 points ago +6 / -0

She also bitches about only getting $800. She lives with us for free and doesn't really have any bills other than a cell phone. I regularly have to tell her that $800 a month in extra money is more than many households with two fulltime working people ever have. She also smokes like a chimney and drinks fancy tea drinks, so like $400 a month of that goes toward her mentol cigarettes and fancy tea.

BlaineBug 6 points ago +6 / -0

Yuck! Kick her out or kick them BOTH out!

10
DenturesNancy 10 points ago +10 / -0

This country should just split into 2. What's the point of keeping a union where the majority is oppresses by a marxist minority? They can keep scotus, fbi, cia, nsa, and all gov agencies with their half.

2
BlaineBug 2 points ago +2 / -0

I agree.

8
-jjjjjjjjjj- 8 points ago +9 / -1

Its just beyond the pale for them to even pretend there is no standing. ACA required states to do all kinds of shit and expand medicaid or suffer penalties. How is the question of whether the law making them do all that constitutional not a case or controversy affecting Texas?

Absolutely egregious.

It's an illegal tax. Was not passed by congress. How is it difficult for people to understand..

7
d3plor4ble 7 points ago +7 / -0

It's time to split America. There's no reason a few communists cities should be allowed to enslave us all. Let their cities burn. Stop policing them.

7
Prometheus76 7 points ago +7 / -0

Lawpedes: what in the hell does "no legal standing" even mean? How can a state not have legal standing to challenge a federal law as unconstitutional in a court of federal law? Isn't that the whole purpose of federal courts? For petitioning the government for redress?

6

How did Texas not have standing after the stolen election???

If government is given more control over healthcare, they will kill like CUOMO who put covid patients back into nursing homes.

These people will kill the elderly without hesitation if given the opportunity. They have proven so

This is why the national government shouldn't be able to tax individuals and have to invoice the state governments instead.

Not a surprise he's being puppetted by staffers.

2
Znut55 2 points ago +2 / -0

What does "expand Obamacare" mean? A HALF MILLION illegals in the country since Biden took office and opened the borders. THEY will get all kinds of FREE stuff from healthcare to education to unemployment to WHATEVER. It's OUT OF CONTROL and we saw what 8 years of Obama did and how communities all over the country were swarming with illegals. Our schools are clearly on overload in the Chicago suburbs and we have MORE bi-lingual classes with FREE EVERYTHING than regular classrooms. The parents are uneducated and clearly do not work. This is a disaster!

2
paulej 2 points ago +2 / -0

Great. Giving insurance companies a license to charge more. If the government would put energy into bringing prices down, people could afford insurance. Competition works (e.g., Walmart pushes down prices). Hospitals don't really have to compete. Neither do drug companies, drug stores, insurance companies, medical equipment providers, etc. They charge whatever they can, and you and I will pay. When competition isn't working, that's when the government should step in, but they don't. Rather, they empower these entities that don't really compete.
