I work for sprouts in CA and as of the 18th there is no mandate for masks at work in grocery stores. I was sent home twice since then and tomorrow will be my third which will be enough points to get me fired for insubordination. We have papers in the break room, by the time clock, and our own website that states that only stores with state mandates require masks. I have pointed this out to them and they don't care saying corporate still requires them. I wrote to HR and they said OSHA requires all employees to wear masks which is 100% factually untrue. We are being told one thing while all posted info says another. Is there a website or a type of lawyer that specializes in wrongful termination? I have everything documented including where HR told me it was my fault their phone operator hung up on me 2 times. A while back a costco employee posted a similar problem here and there was info about someone who specializes in this kind of thing I thought I bookmarked it but it is not there so if anyone has info please help. I have enough saved to last me 2 months of rent and bills but after that ill be empty. Thanks for any help sorry for long post, I've been on this site since before Trump was cheated from the white house and always find good info here.

I hope it helps. Fucking Commies! I’m an independent contractor so I don’t really have to worry about being forced to mask up or get Vaxxed. It is somewhat limiting in my current job because I can’t go down to film sets because they want to do testing and all that. I haven’t taken a CHINA-19 test since this whole thing began. I also haven’t been sick that I know of but then I’ve hardly had the flu my whole life except for when I was in high school 😉. I got sick a lot back then and had to stay home from school.

What type of mask does OSHA require? If OSHA requires anything it will be in a widely published mandate or the standard. I'm an authorized OSHA instructor. Sounds fishy. I'll bet they have 'other' OSHA violations on site.

OSHA as of the 18th has same regulations as CDC meaning no mask mandate for employees unless in hospitals and schools or events with 10k people.

This is not true, pede. CalOsha is following the state mandate that one must wear a mask if not vaccinated. I'm currently dealing with this at my job. They are waiting for me to not follow so they can claim I am not following Osha requirements. They can't ask me if I'm vaccinated though. So when they try to glean that information from me I just act stupid and don't clearly answer.

My company is not doing the segregation of vaxx to unvax yet. That I am sure is next as of now they are making everyone wear one while saying they have to because of OSHA which they do not. If they updated the policy to say this then I would have to but all info in store and on website says my store does not require masks in states without a mask mandate. OSHA website even says unvaxxed must be provided masks by the employer to wear voluntarily which I will not volunteer to do.

according to cal osha you have to wear a mask at work if you aren't vaccinated, and your work has to provide you with a mask, or an N95 if you ask for one.

OSHA exists at two levels and are not related.

OSHA is a federal agency. It functions one way and is limited by federal statutes.

CalOSHA is the state level agency and functions differently and is limited by state statutes.

Information you find from the federal OSHA is not applicable to the state level department.

If anybody asks, tell them you're not comfortable discussing your medical information with anybody other than your doctor and instruct them to call your doctor if they want information. Then give them your doctor's name and phone number. Your doctor is prevented by HIPAA from telling them anything. I keep a few of my doctor's business cards in my wallet to hand to nosy assholes at work. If somebody asks me outside of work, I tell them to fuck off.

This is how you win. Follow their rules. But be very strict about it. A single mask all day isn't good enough because they are not designed to be worn that way. Ask your job to provide you with one mask per hour while you are at work. Wash hands diligently. Every hour, you need to take a break to remove your mask and sanitize then get a fresh mask. Enforce social distancing because they go hand in hand. Be hyper vigilant about any teamates or managers you hear cough or sneeze. They all need to be tested before you are comfortable being around them. Follow their rules so hard that they neg you to stop. it is amazing how effective this strategy can be.

They would probably take them up on that offer but counter with every 4 hours because that’s generally the maximum continuous usage recommendation by most manufacturers. I’m sure they would be happy to accommodate, hell they may even promote him for being a diligent worker.

I’m from CA and my company is doing no more face mask and reentry in Sept. Big corporate company. I’m still waiting to see if they require the vax, but had a meeting today and no word yet. The unfortunate truth is that most attorneys are spineless cowards and are going to shy away from any cases like this one. How many law firms have the same rules in their office or lean left? You can eliminate those ones right off the bat. The risk v reward for them is too skewed. They will make enemies with businesses, the Government and other lawyers. They will be harassed by the Bar for taking the case and threatened with having their licenses suspended. I hope I’m wrong but so far I’ve seen nothing to challenge this hypothesis.

Ultimately, the employer can have a policy for you to wear a mask if it chooses to. You are free to not work there if you don’t agree with an employers policies. They are free to terminate you for violating a policy.

Doesn’t matter what corporate policy is, if a manager at your store makes a policy and an employee violates that policy then they are subject to disciplinary actions or termination.

I think discrimination would be difficult to prove especially if the policy is that all employees must wear a mask. Now if they said all vaccinated can be maskless then you might have a case but still unlikely because the store could offer you the vaccine free of charge (as it’s free for everyone) and then there would be no discrimination because they offered you a way of getting vaccinated.

You are not likely to see anything come of this. Just chock it up as work experience and find a new job, there’s tons of them out there since people don’t want to go back to work.

Its non union so yes we are all at will but basic termination practices when I am following all posted rules should be impossible. If they updated the website or the info around the store I could understand them still forcing the masks but as it stands the info says only masks with state mandates which CA no longer has. So I would get fired for not following a verbal command that is opposite the company's written policy. I am the grocery manager 4 years with the company.
