I keep trying to explain this to people. When I was a kid corruption was a big fucking deal. Even a local dogcatcher would take hell if they spent two pennies wrong from their budget and everybody was afraid of the ramifications of doing anything wrong. There always threats of hearings and lawsuits and every little tiny thing was taken in extreme importance.

The judge passed on the chance to hold Maricopa County in contempt of court, instead putting all the responsibility on the Senate to vote on it. Right now, I don’t expect the judge to suddenly change course when they already have a track record on this audit.

My understanding (not a legal pede.)

The senate is issuing the subpoenas, so they're legislative subpoenas, not court ordered subpoenas, and that makes a difference in the teeth they have. The senate can send the sargeant-at-arms to arrest the board members, but only after they've voted to hold the board in contempt. They tried that in February, and Republican Paul Boyer defected and voted against the other 15 Republicans, so the vote failed.

When the board refuses to comply again, the senate will hold another contempt vote. This time they may have two Republican defectors, if Michelle Ugenti-Rita joins Boyer, but Sen Wendy Rogers has implied that Ugenti-Rita could be talked into voting with the Republicans.

Judge Thomason confirmed the legality of the subpoena in February, but he did not rule that he would enforce it himself. He could have, but there's language in his ruling that implies he might not support the senate if they go to him with a motion to enforce.

Another fact: in February, Judge Thomason was appointed to rule on the subpoenas by the wife of one of the board members. (Judge Pamela Gates is married to Bill Gates, and she appointed Thomason.) Thomason replaced an earlier judge that might have been more sympathetic to the senate, but the Dems pressured him to remove himself from the case... because of a conflict of interest.

Long way of saying, it's the way the AZ laws are written. Fann has to find a legal pathway that works. My understanding is there aren't a lot of good options, if all 16 Republicans don't vote to hold the board in contempt.

Some have suggested the AZ senate could file a special motion to enforce the subpoenas with a new court, and go to the AZ Supreme Court. That court might be slightly more conservative, but I don't know if Fann and the senate attorneys are considering that.

Yup, that one. Liz Harris said in an update video that Sen. Wendy Rogers did an interview on OAN, in which she said she thought it might be possible to convince Ugenti-Rita (I didn't see the OAN piece.)

Sometimes vain, shallow people with no deep convictions can be swayed. She does have many years in office as both AZ Representative and Senator; and maybe Rogers knows her well enough to have some insight. But it surprised me too.

Or, maybe Rogers was just spreading hopium.

I've tried to get a read on AG Brnovich as well. He's made some good moves to defend the audit against SoS Hobbs, and threats from the Garland Dept of Justice. And his recent win in the SCOTUS case is a feather in his cap, and good for election integrity in AZ.

But he was the first high level AZ Republican to say Trump would not win AZ, and he threw cold water on the claims that Rudy Giuliani and the Trump team were making, about needing to investigate fraud.

He sat with Gov Ducey and SoS Katie Hobbs when they certified the election for Biden, right in the middle of the hearing about election fraud held by state legislators. The fact that they scheduled the certification in the middle of the hearing was generally seen as an insult by some Arizona conservatives, who wanted to at least hear the testimony of Arizonans.

Brnovich did a Nov 12 2020 interview with Neil Cavuto, characterizing the allegations of AZ election fraud as a conspiracy theory. Partly why Trump has made some negative statements about him, saying that Brnovich needed to start showing some support for the Maricopa audit.

I don't think Brnovich was gung ho about the Maricopa audit at the start, but on the other hand, he hasn't allowed the Dems to derail it.

TLDR: mixed bag. Not sure if he'd be 100% trustworthy if they handed him an investigation into MCBOS, but I'd like to know what AZ pedes think.

You have to think back to the other rigged elections. The metric was to ramp up partisan divide, and then give several months of bipartisan smooth sailing to let the steam off. The news is still ramping for an election or a war, which means they know that something is coming. If the Deep state were actually back in control, they would be pretending that everything was normal again. That elderly gentleman still watches Fox. It's very unlikely after forty years of TV training that you will get him to look at any other news source. My father-in-law is very similar. He will tell you how corrupt the Democrats are, admit that he was not sick in the 500 Days of coronavirus lockdown, but still thinks that the Johnson & Johnson shot is a good idea. Even if you lose a friend you have to tell them the truth. There is no major news organization that isn't lying to us wholesale.

Democrats are breaking laws in areas they control. They own the police, the prosecutors, and the judges in their districts. How would a republican politician even go about securing justice in such environments? The law is nothing without enforcement, and democrats control enforcement everywhere they commit their crimesn- including D.C.

Blue states ignored federal laws and mandates when republicans controlled the federal government, and now red states are learning to do the same when the roles are reversed. We've already got conservative states lining up to reject the next round of mask mandates and vaccine passports. What happens when those requirements go federal?

The only long-term solution is secession. We are already two nations. The only way to relieve the friction is to make it official.

Exactly, this is the real problem right now. Paul Boyer and Michelle Ugenti-Rita may block the vote to hold the board in contempt. Without that, the senate doesn't have the power to arrest the board members. So why should the board be afraid of not complying?

If you're conversant with the different kinds of machines (I'm not), this website shows the voting equipment used in every AZ county in the 2020 election.

I think they want to make the biggest push possible for the missing items, too. I hate to think their report will be partially incomplete because the corrupt board of supervisors succeeds in ignoring the subpoenas.

@Abraham: It takes a lot more time to collect forensic evidence about 2.1 million ballots than it does to certify fraud. The auditors have opened boxes and found absolute chaotic messes in some boxes. Bennett has mentioned 20 to 25 thousand duplicate ballots without serial numbers; that's a violation of state law, because without serial numbers, there's no way to pair up the original ballot with the duplicate ballot.

Tally sheets don't match the contents of the boxes, records are missing, and Maricopa County refuses to answer a single question about any of it, in person or by email. And these are only a few things that have been made public in comments at hearings.

The auditors and Fann know this will all end up in court, and their documentation will have to stand up to examination if they hope to make their case. I wish it was faster too, but I want them to have a strong case, and take the time they need to get the truth out that we all deserve.

I completely agree that there are lots of double standards. But in this case, the problem is that this is not a court ordered subpoena (as some articles imply.) Legislative subpoenas don't have the same legal force, unfortunately, unless all of the AZ Republicans vote together to hold the board of supervisors in contempt for not complying.

In this case, it's the way the AZ law is written, coupled with the fact that at least one (maybe two) traitorous RINO is intent on siding with the Dems on the senate contempt votes.

I'm just pointing out, the purpose of this letter wasn't to threaten the Board of Supervisors. Fann made this statement to deal with a controversy caused by the senate's own liaison, Ken Bennett. In violation of the audit rules, Bennett shared some information about the number of ballots in some boxes with outsiders. Those outsiders went to the press, and that's spurring a lot of bad PR for the audit right now, on lefty sites.

The senate purchased two counting machines recently to do a final check on the total number of physical ballots. Their attorneys suggested this because (apparently) there's a discrepancy between the audit's total number of physical ballots, and the county's total number of physical ballots. This is a third count to verify and double check the audit's total.

Bennett was not put in charge of this last final count; another assistant liaison was (a retired auditor.) Bennett expressed dissatisfaction about not having access to more information about the final counts.

Fann wrote this letter to formally state that Bennett's actions were irresponsible and in violation of the audit rules, and it's why he's been locked out of the arena building where they're wrapping up the last of the physical audit activities. She also wanted to clarify that Bennett will be assisting in the drafting of the final report. He's still the audit liaison.

Dammed no matter what they do. I think their approach is sound. Be professional, publicize the enemy's efforts to stonewall the investigation and make sure the outcome is 100% solid. This should be the model for other states. On the other hand, playing ethically puts you at a disadvantage when dealing with psychopaths (most of the deep state, judicial system etc.) who have no such restraints.

I gave you one example of a government owned plane, which the government admits is a surveillance plane, flying a repeating pattern in the vicinity of the audit. Why are people complaining in this thread? This is a straightforward press release to end the BS from the media that the auditors are partisan because they banned Ken Bennett from the recent count. Especially since Ken was going around on media playing victim.

Now we know the auditors had nothing to do with it (the separate, independent team did) and it was justified (dude can’t shut his mouth despite being told to).

Oh and if they needed an independent count, isn’t that a big enough hint that there is a serious issue between the votes counted by the Cyber Ninjas and the total reported by Maricopa? Agree (apparently, you've been following the bread crumbs...) I know that Karen Fann's statements have frustrated people, when she's said the purpose of the audit was about future election integrity, and not about overturning the election.

But if Fann had started out saying the purpose was to overturn the election, she would not have had enough legislative support to make the audit happen. (Look at how audits are being fought, in every state.)

And in Judge Thomasen's ruling that gave the audit the go-ahead, he stressed Fann's statement about future election integrity. That gave him legal grounds to rule that the senate had the right to secure the election materials, so things moved forward. If Fann had made statements saying she wanted to overturn the election, there's no way Thomasen would have ruled the senate had the legal grounds to have access to the election materials.

i apologize, and you are right. i'm still really blown away/shocked/angry ken bennett decided to break protocols and share proprietary information that did not belong to him threatening the credibility of the audit. millions of people are watching this audit. thousands of people donated their time and risked harm and reputations to participate, many as volunteers. this is the engine of activity affecting audits all over the country.

ken bennett shared data on 24 boxes out of 1600 boxes and narratives are going around saying those 24 boxes demonstrate there is nothing wrong with MC's handling of the elections. he was secretary of state, president of the senate. maybe this was just bad judgment, i can't really fairly accuse him of anything except it really looks inexplicable.

You don't even need proof of fruad to show something is wrong - look at Maricopa refusing to follow orders via the subpoenas. The fact they're lying about the routers for example shows their reasonable doubt and that alone can be used to the advantage of the movement.

  1. Arrest those complicit with obstruction. If this crime involved a private citizen rather than a government official, there would no doubt be no need for a second vote to enforce the initial subpoena for collection of evidence.
  2. Release the information you already have. I appreciate that you’re trying to be procedurally accurate to improve the validity of the audit, but delaying too long to release results of what you have is just as harmful as rushing the process.

It sounds like he only leaked information about the number of ballots in some boxes on the arena floor. He didn't leak (and probably doesn't personally have) information about vote tallies in those boxes, just the physical number of ballots.

The outside auditors wanted that information to verify their own spreadsheet, made from information they got through a public records request.

The outsiders are two retired execs from an election software company, and a retired data analyst. They've been trying for months to prove to the AZ senate that they should have been hired to do the audit, and that the Cyber Ninjas are incompetent. Unfortunately Bennett gave them information that they could use to pretend their claims are verified, even though that's not correct. The lefty media will run with anything.

I haven't see any numbers published in the articles, because they're pretty meaningless, and the outside auditors want the public to think they have something meaningful. If we knew that Box Number 34546 had a total of 542 ballots, that doesn't tell us anything.

For some reason the retired executives from Clear Ballot think that if their spreadsheet (with ballot totals per box) matches the actual totals of ballots per box on the arena floor, it gives them credibility. I think it gives them squat, and Bennett even said that some of their public information ballot box totals matched his info, and some did not.

I think the point is, the Clear Ballot guys, and Benny White, just want to be able to day "Ken Bennett verified our spreadsheet totals, and that means we've been right, and Trump lost." Ken Bennett could have given them his shoe size, and they'd still say that.

New tactic that could achieve quicker results is highlighting counties in hard red states with full control. Taking Kesher's 30,000 foot view of irregularities and targeting R controlled areas that show fraud (FL panhandle for instance). We won't get the slow walking BS. There will be less fraud totals and less impact in terms of overturning the result but quicker results and receipts of wrongdoing.
