Was on planes about 12 times a month for two years. Every single time they'd say "it's against the law" or "the law says" or "according to the law" - I ALWAYS audibly said to everyone around me - it's not a law.

I agree with you in principle, but just to challenge you a little bit: what makes something a law? Biden issued an EO instructing the FAA to exercise its powers. The FAA is legal under 49 U.S. Code § 106. Courts have ruled the FAA has power to ensure "safety" which they have also ruled to include the concept of "health". This is all "legal" under the Commerce Clause. Now a better question would be, is the US SC interpretation of the Commerce Clause legal and/or lawful OR NOT in accordance with the values expressed in the Constitution?

Yeah that was what I was going to go for. Thing is the FAA was originally private, before the feds came in. Those funds made during the private days was kept private, in that respect to this day that private corporate interest is still there. They and the feds bump heads all the time always a pendulum based on who was the leverage.

However we're still talking over a layer of a legalese that ought not be there in the first place and would similarly remove all of the three letter agencies if honored.

Passed by an elected representative congress and not in violation of the Constitution.

Constitution allows congress to make laws. It does not allow them to delegate their authority to pass laws (to the FAA, FCC, FDA, nor anyone else). And all laws repugnant to the constitution are null and void.

So it's a pretty easy challenge, just need to reference the Constitution.

Congress can NOT delegegate to the bureaucracy legislative power. A word like safety can only be defined by congress because we live in a system where the power of government is limited and not expansive per the constitution.

What about small planes? If you are an American citizen in your 50s, you lived in the US at a time when teenagers were offered and allowed to go to flight school to learn how to fly small planes. even Canadian Military school had this program [This teen activity disappeared after 9-11] ,

I read the executive order authored by Trump in 2020.

It states (in one sentence) something like: DHS shall assist the CDC is preventing the spread of COVID-19.

DHS has turned that into mandated/coerced passenger and employee behavior at risk of denial of service to unemployment or disciplinary action.

The criteria to declare the emergency outlined in the initial executive order would be the first place I would attack. The disease is no longer killing or injuring (if it ever did) people at rates necessitating a nationwide emergency.
