Let's not forget that that faggot ceo is STILL going to force Pureblood employees to pay hundreds of dollars more in health care premiums on the company plan. He's still a criminal turd engaging in criminal activity.

I still don't understand how anyone thinks making them pay more for insurance is legal. That was the one things that was very clear in the ACA. May not like the law but when it benefits me I am sure as hell going to use it against them.

If the IRS were not politicized, it would seem that they would no longer meet the requirements for the tax shelter that companies get for employee medical. They must not be afraid of that, for some strange (nefarious?) reason?

Yes, it’s a troll. No value added here, just an assertion that “a=b” with little to no backup for the claim.

I tried engaging before, to little effect. This troll will accuse you of stupidity, bad faith, or resort to ad hominems mixed with more incoherent arguments.

And when finally cornered, the troll will just run away & create another username (see figgle, etc). But no hard feelings. Hoping everyone here at least has some fun and learns a few useful things, even trolls and other such critters.

Buh-buh they were only doing what we threatened them to do based on the science at the time! We can't punish them now!

The science 4 months in said you only had a high risk if you were old with multiple contributing health issues. They sent law enforcement to RAID anyone trying to find a treatment , and demonized any that showed promise. They spread false studies far and wide which were retracted. Doctors said to use treatments early, but studies were done for late stage, defeating their high success rate, set up to fail. Still they showed a year later comparatively high success when mistreatment was purposely done.

The official treatment includes a poison that was pulled from the study cited for it's efficacy because it had the highest mortality rate (51%), and its side effects mirror COVID death symptoms.

If this is science, science is bullshit. Fuck fauci.

it is allowed...it is why smokers pay more than non-smokers.

41
Joshua2001 41 points ago +43 / -2

It is not. That provision is specific to tobacco users. There is another provision that allows them to offer discounts for things like vaccination and exercise but that isn't what is happening here. Penalties are not equal to discounts.

https://www.congress.gov/111/plaws/publ148/PLAW-111publ148.pdf

‘‘SEC. 2701. FAIR HEALTH INSURANCE PREMIUMS. ‘‘(a) PROHIBITING DISCRIMINATORY PREMIUM RATES.— ‘‘(1) IN GENERAL.—With respect to the premium rate charged by a health insurance issuer for health insurance coverage offered in the individual or small group market— ‘‘(A) such rate shall vary with respect to the particular plan or coverage involved only by— ‘‘(i) whether such plan or coverage covers an individual or family; ‘‘(ii) rating area, as established in accordance with paragraph (2); ‘‘(iii) age, except that such rate shall not vary by more than 3 to 1 for adults (consistent with section 2707(c)); and ‘‘(iv) tobacco use, except that such rate shall not vary by more than 1.5 to 1; and ‘‘(B) such rate shall not vary with respect to the particular plan or coverage involved by any other factor not described in subparagraph (A).

https://www.congress.gov/bill/115th-congress/house-bill/1313/text

You forgot about this though...

(3) in enacting the Patient Protection and Affordable Care Act (Public Law 111–148), Congress intended that employers would be permitted to implement health promotion and prevention programs that provide incentives, rewards, rebates, surcharges, penalties, or other inducements related to wellness programs, including rewards of up to 50 percent off of insurance premiums for employees participating in programs designed to encourage healthier lifestyle choices

so technically it is legal under this, depending on how the company words their policies.

That's like blaming a gun for murder. The laws don't suck, the legislators who write the laws suck, and the legislators who vote for the laws suck. And, well, OK, you're right, in the end, it is the law that sucks as well...

6
Joshua2001 6 points ago +6 / -0

That is correct. They would need to be offering discounts for employees that got the shot. The provision that you are relying on is pretty specific. It isn't what you quoted as that is just a generic description of the legislation. The link below goes to that section. Wellness programs allow for discounts or premium reductions not increases. So they could offer everyone a premium reduction as a reward for being vaccinated but they could not offer a premium penalty for not being vaccinated. And even then they may not win as it unclear if other provisions wouldn't prevent it. Like whether it is reasonable and if they are offering accommodations or if it violates the provision for genetic information or receipt of health care or medical history.

1
SteelDriver 1 point ago +1 / -0

I agree with you, but I suspect the courts will agree with progun_prochoice's point ("it's just a wellness program discount").

5
deleted 5 points ago +8 / -3
7
progun_prochoice 7 points ago +7 / -0

right...the point is they can't charge more, but nothing says they can't charge less using the wellness incentive. "if you get the vax we will give you a 10% discount" is legal vs "if you don't get the vax we will increase your premiums 10%" is not. and they can disguise it by raising rates across the board, unless you have been vaxxed, in which case yours wont rise. that is perfectly legal under the current laws.

3
Steven_IDGAF_Miller 3 points ago +4 / -1

A vax is not a wellness program.

No matter how much doublespeak the left tries to insert into our language. There is no way in hell that an EUA experimental gene therapy can ever be considered a 'wellness program'.

4
doug2 4 points ago +4 / -0

What's the difference between a discount and a penalty? Ok guys the extra 5k is now standard. O vaccine people, you get a discount to the old rate

7
RStroud 7 points ago +7 / -0

Gets complicated. Senior discounts, "ladies night", and affirmative action are okay even though they're obviously a form of discrimination. The case law on discrimination is a confusing maze of contradiction, even though the (constitutional) law is pretty clear. Long story short is blacks, females, and recently gays (which are somehow a sex) are the only truly protected classes. You can screw over anyone else with impunity. If you don't like it, you're racist, sexist, or homophobic.

3
RStroud 3 points ago +3 / -0

I'd add that current case law has no objective test for race/color, sex, or sexual orientation. They've consistently ruled that genitals, doctors' opinions, and melanin content don't matter. Anyone can be a black female lesbian, like myself. You just have to hold yourself to be one consistently and publicly.

3
SteelDriver 3 points ago +3 / -0

Ask John Roberts. The difference between a discount and a penalty is the same as the difference between a penalty and a tax. ;)

itoobelieve 1 point ago +1 / -0

Guys this is just corporate double speak. The schmuck is still enforcing a December 8th deadline. No one is going to "lose their job" they'll just be given the choice of unpaid leave for an indeterminate amount of time or "voluntary separation from the company."

This is literally what every contractor is trying to do. "If you refuse, you'll be considered as voluntarily choosing to separate from the company of your own volition. No severance paid. No education reimbursement for the classes you started before this all happened. You'll owe us for the classes we already paid for since you're voluntarily ending your employment. Also no unemployment since you quit. We'll provide you with a reference though."

Wake the fuck up people. These are PR statements. Until a CEO comes outright and says "Fuck Biden, send as many fines as you want, we'll see you in court, " this is all theater for idiots who dont understand what's really happening.

That's not what's going on.

The CEO is not only a a Member of the World Economic Forum - he's a Contributor.

This whole debacle is just to buy time so that he can:

  1. Have human resources only hire people who have been vaxed
  2. Replace as many unvaxed employees with vaxed, especially with attrition from all this nonsense
  3. When the percentage of unvaxed is less than 20%, reintroduce all of these actions and force them to leave or get vaxed

He just took action too soon, with too many still unvaxed.

The instant this changes, it's back to his original plan.

People need to understand this.

We are in a decade-long war, in the second year.

6
rentfREEEE_since2016 6 points ago +6 / -0

No. Because the CURRENT CEO is ALREADY slated to retire Q1 2022. Has been for over a year. He already has a replacement lined up. His role now, is to absorb the BS until the new CEO steps in, at which point Southwest will have the opportunity to do whatever they want.

4

I don't buy it when people say CEOs are required by law to maximize profit. The thing they are required by law to do is whatever the shareholders want it to do. It's just that typically that means "make as much money as possible", but it's not coded into law... is it?

0

4
decafllort 4 points ago +4 / -0

This Stack Exchange question's top answer says no, maximizing profit it not required by law, no statute puts shareholders at the top of the hierarchy, and even corporate charters typically don't contain "maximize profit" wording. Maximize profit doesn't even make sense, it's too vague of a concept. https://skeptics.stackexchange.com/questions/8146/are-u-s-companies-legally-obligated-to-maximize-profits-for-shareholders

The Vaccine Mandate is happening beginning of Q1 2022. The Southwest CEO is just trying to get on the "good side" of people on the right, knowing full well that he'll eventually "have to" cave once the mandate goes into effect.

7
wizzingonwallstreet 7 points ago +7 / -0

No defending the guy but you're thinking of the OSHA mandate which hasn't happened at all yet.

The federal contractor mandate started in Sept with a Dec 8 deadline.

The federal contractors, like SouthWest and the company I work for, were told 100% vaxed or their contract will be terminated.

So businesses are free to not mandate the vax, but no more federal contracts.

Plus, for fun, even if you don't work on the federal contract is doesn't matter to the gov, they still say 100%.

That's how they do it.

If these pilots were really "heros" and standing up for freedom and not just trying to save their own asses then they wouldn't go back to work until all that shit is done with and the government itself caves on everything they are saying!! This is war not "save the poor pilots jobs"
