I was already fired from Washington State DOT on Oct 18th due to Inslee's proclamation. I will not comply with Biden's OSHA mandate either. This is not the freedom I fought for. This is not what this country stands for.

Some (millions) people don't care and say:

"Ah, vaccines are already required for school and many other things. What's one more to help end the pandemic?"

Because they are brainwashed, they don't realize and understand that mRNA vaccines are a new type that have never before been used before, and that there are serious issues with delivery of the vaccine and great unknowns about the long term effects.

Even great of a concern is the complete lack of awareness of what's happening and the slippery slope these people are creating.

These same people that think "Ah, what's one more" don't realize that "one more" means tomorrow there will be one for they don't want. For example, How do you feel about vaccines, drugs, and other "life saving" treatments that will be deemed "necessary" for society by experts. Do you want a "vaccine" for these things:

  • Caner
  • AIDS
  • Obesity
  • Headaches
  • Depression
  • Aggression
  • Colds

If they can do this now, when there is clearly no threat (75,000+ people routinely gather weekly in my state's university football stadium, and cases & deaths went down since they started this), then imagine what they will do tomorrow with this new power they've acquired?

  1. COVID is barely deadlier than the flu. It is less deadly if you only count people under 70. The measures we are taking are not proportional with the risk.

  2. The media has hyped up the virus with fear campaigns. A recent study showed Democrats believed up to 50% of symptomatic COVID cases result in hospitalization when the reality is close to 1-3%.

  3. The vaccines are not proving to be effective. Cases are not falling with increased vaccination rates, even as those rates approach 100% in certain areas.

  4. The stated effectiveness has slowly been walked back from 100%. It is clear nobody really knows how effective the vaccine is.

  5. Short term risks have been covered up and denied, despite death being a risk.

  6. Long term risks are unknown.

  7. There is no liability on the manufacturers, government, or employers.

  8. Existing medications are likely more effective than the vaccine, but they have been attacked by media and the FDA won't approve their use.

  9. The FDA can't be trusted. They lied in the Comirnaty approval letter, claiming there was no controversy surrounding the vaccine. They used that justification to skip the advisory board process, which had never been skipped for any vaccine since its inception. In addition, they stacked the advisory board for the age 5-11 EUA with people who had clear conflicts of interest.

  10. If the government can mandate this medical procedure, then where does their authority end? Can they mandate lobotomies? Can they force sterilization? Can they force gender reassignment to meet diversity or affirmative action quotas?

  11. It is becoming increasingly clear this isn't about health or safety. This is about power and control. As other countries are demonstrating, vaccine mandates lead to vaccine passports, which leads to social credit and full control of your life. That is not freedom. That is not America.

I will not take this vaccine and I am very angry right now.

This is not actually true (or at least it's true in coronaviruses, which are positive-sense ssRNA viruses). Some RNA viruses, like negative-sense ssRNA viruses require RNA replicase to copy their genome into a positive-sense ssRNA.

Structurally, there is a difference between the "vaccine" mRNA and COVID ssRNA: The therapeutics only code for the spike proteins. The COVID RNA codes for the entire virion and goes through several additional steps that aren't necessary when coding strictly for the spike proteins.

I called the Texas Attorney General.

I asked to speak with "A specialist regarding covid vaccine mandate" and the person I spoke with said they have a pending court case that will determine whether or not the governor's EO or any state law would take precedent over Bidet's EO. In the meantime I "reported" my company for being in violation of the Governor's EO, they wanted that info and said they would use it to act quickly if the courts issue a stay or rule in favor of the state.

Page 62/63 contains exemptions to the rule. The first applying to those who perform work in isolation or telework (work from home). And the second to those where work is predominately done outdoors. There's a reason large corporations like Microsoft moved their entire workforce home last month.

Beyond that, OSHA’s grave danger determination exempts several categories of workers based on characteristics of their work or workplace: 1) workers who do not report to a workplace where other individuals are present or who telework from home; and 2) workers who perform their work exclusively outdoors.

It seems that OSHA is punting the responsibility off to the employers and are not actually mandating the jab. It is up to the employers to decide on mandating jab or allow testing.

It looks like religious and medical exemptions still apply.

I do think requiring only unvaccinated to wear mask and perform testing (a medical procedure) is discrimination and violating the law. Just now sure how that will play out in court.

In order to sue an employer for religious discrimination under federal law, you are required to first submit a compliant to the EEOC. The EEOC can investigate and attempt to resolve. IF they cannot resolve or they don't want to investigate, they issue a right to sue letter. You legally do not have standing to sue for religious discrimination against an employer without this letter. Lawyers won't even take your case.

If this goes on long enough, some lawyers might start pushing the non-EEOC path. Basically right now they’re doing single cases to get precedents from rulings. It’s a slow and costly process unlikely to impact the current situation at all and is just laying framework for future cases.

Most likely way it will work: EEOC will issue blanket settlement or rejection of claims well beyond their maximum time limit. People will be allowed to accept settlement terms if present or decline for right to sue, then people will get right to sue. Expect this process to get strung out for a year or more. EEOC has basically said they won’t do anything until May IIRC.

So it’s still worth getting fired, filing the claim, etc. You‘ll eventually get something. But it’ll probably be 2023 or later before anyone gets a penny.

The "right to sue" letter is the first step in filing a lawsuit. (Once granted, you are required by law to file the written complaint-- the lawsuit-- within 90 days.) It would fall under the attorney's scope of work. So the lawyers you spoke with were not being straight forward with you.

I considered a fake card but I didn’t because I feel like considerable effort will be expended to catch you retroactively via a simple database which I’m sure the feds will fund. My company is a contractor for a certain extremely evil corporation.. HR sent out a notice to us a couple months ago stating that anyone who visits the office will be have to be vaccinated. At that time, I primarily worked out in the field and never had any reason to go to the office, but now our entire division (quality control), is going to be entirely remote work. Surely they won't demand their remote workers to be vaxxed. If they do, literally our entire quality division will have to be fired and they're going to be screwed. ALL of us are based and nobody is vaxxed.

If you live in a blue area or even a moderate-sized town, try moving somewhere more rural. You sound depressed. I was when living in California, and just the change of people moving to Florida made a huge difference.

  3. if not able to visit a site or come back will be considered "voluntarily resigned"

testing only applies to those in the workplace, so remote workers seem safe for now but must take a negative test within 7 days of returning to the workplace.

EDIT I've been reading the document and employees who work remotely or outside exclusively are completely exempt from this mandate.

OSHA cannot prove Grave Danger to those people.

Bulfone et al. attributed the lower risk of transmission in outdoor settings (i.e., open air or structures with one wall) to increased ventilation with fresh air and a greater ability to maintain physical distancing (November 29, 2020). While the best available evidence firmly establishes a grave danger in indoor settings, the CDC has stated that the risk of outdoor transmission is “low” (CDC, September 1, 2021) and OSHA is unable to establish a grave danger in outdoor settings from exposure during normal work activities

That is me -- I, and I alone in my company, have been coming in to the office every single day since this mess got foisted upon us. Except of course for holidays and scheduled leave time. Only me.

I got so used to having the entire place to myself. It was paradise. I am the "IT guy" for our small business, and every time people would try to manipulate me into staying home, I would tell them that I needed physical access to all of the equipment I am responsible for. Which is 100% true.

But still they did not come into the office. Only I did. Why didn't they? Were they scared? Who cares? It was their decision.

But NOW these assholes are starting to trickle back in, and now I am supposed to change how I have been doing things for the past year and a damned half?!? Tell you what, lefty assholes, you lazy cowards have been hiding in your basements for EIGHTEEN MONTHS, why don't you just keep doing that?

Most of it already is set up, but for a few things, I have disabled access from outside our internal network. I just don't want the security risk. I do love those DRAC setups though...

Some of our backups are also done to a not networked drive (in case of Cylon attack), which each Friday I swap out the drives and take the old one home with me.

I do not live too far from our office, and while I have had to come in on a few Saturdays here and there, so far it has not been a big deal.

Great suggestion though, and if they try to push the vaccine on me, that may be my "out."

This verbiage makes it seem like the rule is to protect an employee from "grave danger" of getting COVID-19 at the workplace themselves... not spreading it. Which makes sense, because the vaccine doesn't stop a person from spreading it, it only serves (allegedly) to protect the person who has it.

But if that's the purpose of this ruling, then what is the purpose of requiring a negative test before going to the workplace, but only for unvaccinated? Is this ruling about protecting the individual from others, or protecting others from the individual? It is wildly inconsistent.

Clearly the negative test requirement is designed as a punishment for those who do not comply.

This bit about not requiring remote employees isn't about being consistent; it's about reducing the ability for people to sue over it. The courts have already specified that a ruling like this has to be narrow in scope, so any verbiage they give to make it seem like it's narrow just prevents lawsuits from going anywhere.

I think a case is there to argue this. Since they don’t stop contagion, ALL employees, vaccinated or otherwise should be held to the same standard re: testing/masking and thus vaccination status is (in the words of the Supreme Court) “moot”.

Just watch the fury that erupts when the sheep are forced to live by the same standards that they want to force on others.

We're at the point now where in places where vaccine passports are in force, one can be double tapped, but infectious, and get waved through. Whereas if unvaxxed and free of infectivity, one would have to start a hoop jumping game.

It appears they're also considering expanding this for all companies, even under 100. I don't know if my employer will comply. We are only a handful of people, and he can afford the fine if it's just me (heck, he can even take it out of my pay and that would be okay) but I don't want to have to walk away from what is basically my dream job after I just got it...I WILL, because I can't risk the vax, but I don't want to.

If it’s a small company, talk to him. Ask if he wants you to file a religious exemption to make sure he doesn’t get fined. Be honest and say you are morally (and religiously, if true) opposed to getting the vaccine. If you don’t want to discuss why on the spot, say you’d rather collect your thoughts calmly since you get angry talking about it.

Oh, I'm friends with my employer actually. We're on great terms. I was his mentor for a while. I will totally discuss exemptions with him when the time comes; but for now I mentioned health reasons and he said that was 100% okay.

It's a tiny American company that hates China and refuses to work with/outsource/market to them. There's very little better that I could ask for.

I fully acknowledge I was wrong. I thought the OSHA rule is so obviously invalid they’d never publish it since it’d open up lawsuits and end the coercion through threat. They’re using an emergency power that didn’t hold up to implement safety rules for asbestos. That’s how far out there they are. I celebrated seeing the news today! You’ll see TONS of lawsuits.

I knew the contracts would exist though. They’re shielded from public view enough.

It is very surprising that they actually put out this OSHA rule. However, it is guaranteed to be fought hard by many states; especially states that actually have laws that directly contradict this. Especially when they say explicitly that this will trump the state laws. That is the biggest spit in the face of states rights.

I expect the courts to temporarily delay the date of implementation while it is being litigated. And I believe the litigation will lead to a heavily neutered version of this rule, or it going away entirely. Only time will tell.

Keep in mind: it is incredibly obvious that over half of the country disagrees with this kind of ruling. Virtually every republican, plus also many liberals.
