That would look very bad for the state, as he's supposed to be the only surviving "victim". One juror is sufficient for a hung jury, but they'll just retry him. It would be much better to get an actual Not Guilty verdict, but that requires consensus.

Even if he gets a Not Guilty verdict, the feds might try him again under a slightly different statute...so he's still not out of the woods from double jeopardy even then.

And if he beats that, then he has to face the civil suits for wrongful death.

Defense of others can come down to facts over perception, but this doesn’t apply here.

This witness you speak of just testified that he is a trained medical professional and he saw Hubert inflict "head trauma" on Kyle. Which is grounds for self defense against Hubert.
